We were shopping at Home Depot earlier, our New Armada was hit by a stray cart, can home depot be responsibe?
We were shopping and came out to see a Home depot shopping cart in Home depots lot resting next to our car, There was a 8-10 inch scratch through the paint. I reported it to the manager and he informed me Home Depot was not responsible, is this correct. Thanks for your help!

the question is, how far and how long are you willing to pursue this? you probably could get them to pay if you are persistent enough, but do you want to expend that much energy on something like this? You might get a repair estimate and send it with a letter by registered mail to the manager, and see what happens. if they can tell you are determined and persistent, they probably will pay you off just to get rid of you. it's not uncommon for customers to slip and fall in big stores like this and they have insurance for claims by customers.

I wouldn't expect a manager to admit to liability even if the store is liable. It may be or it may not be. It can only be held liable if it is found to be negligent. The mere fact that one of its carts damaged your vehicle is not enough. If steps are taken to offer customers a cart collection point in the lot (such as a 'rack' or 'pen'), so that there is another option besides leaving carts loose all over the place, the store has taken reasonable measures to protect vehicles from loose carts. Additionally, if the collection points are swept periodically by an employee to prevent overflow, the store has acted reasonably.

If there is no collection point and carts are left lying all over, or the racks are full and the store is lax in emptying them, it can be argued that the store was negligent, and you may have a winnable case.

If the store has met the test of taking reasonable precautions, the fact that some lazy customer didn't use the rack and it was that cart that damaged your vehicle, you might have a case against that person, if you have proof such as a clear video. But expecting the store to police every lazy customer and every cart at all times is not reasonable, and you probably would not win this case against the store.

This is where your collision or comprehensive coverage kicks in. That it was a Home Depot cart is rather irrelevant. This is similar to being hit in the Home Depot parking lot by another car. If the driver doesn't fess up, you call YOUR insurer.

They're only liable if they were negligent and they weren't.

usually there will be a sign of some sort in the parking lot of businesses, that say they aren't responsible....but if there is no sign I don't know that can say they aren't responsible.

Why would home depot be responsible? That's like parking on a city street in front of a store and then blaming the store for a pedestrian keying your car..
It just goes to show you, you should take the time to bring the carts back to their designated area in the parking lots, or inside the store. This, among other things, is what happens and unfortunately you were on the recipient end this time.
Oh and most of the time they have small signs up that state they won't be responsible for any damage. The same rules apply that would apply anywhere, park at your own risk.

Whether they are legally responsible or not, the amount of time and energy you will waste just TRYING to seek compensation will far outweigh the cost of the repair.

If you can afford a brand new Armada, you can afford to have it fixed. On the other hand, you probably have more important things to do than swim through red tape for the next six months.

It's easier to give up and handle it yourself.

If this kind of thing is going to be a real problem in the future, you might consider getting insurance with no deductible.

Well, if you take one of those carts and slam it into someone's car, then leave would you expect the store to pay that person?

No, they are not responsible.
