Depending on the type of job it is required through regulations. Some companies establish their own rules, but when I was operating a trucking company, I got fined 2000.00 dollars from the state. I did have drug testing on file, but I was not aware of the random drug testing that was required. There were only two people working. I was suppose to place their names in a pool, through a medical facility. And then they were to pick names from that pool. I showed no records of that. Hope that answered your question. It may not be the employers picking on you,but state regulations. |

When you got your job, did you receive and sign a statement that says "drug free environment" and required you to submit to drug tests? If you did, then you accepted those conditions when you accepted the job. They can't really MAKE you take a test. But you not taking it can be grounds for dismissal.
If you have a job where you drive, handle money, or do something where others may be injured if you are impaired, your employer may require drug tests.
If there was NO such agreement before you accepted the job, or no written company drug policy, then you might - MIGHT - have a case for refusing a test. But then you are getting into lawyer territory.

read the company policy or handbook. it should tell you when and why they drug test. if you are being singled out for no reason call the labor board and ask if they can help....if you take drugs and they have a reason to test you that is valid, quit and stop doing drugs! |

none... employers are permitted to test employees at any time for any reason. The most common reasons are for pre-employment screening and after a serious workplace accident has occured. But that doesn't keep them from mandating a random test whenever they want. |
