QTIP
What can be done if an employer is cheating its employees out of 2-6 hours of OT pay each pay period ?
Need help ASAP ! This is in KY !

First and foremost keep track of all time worked including regular hours and overtime. Check your records against those of your employees. If possible get a print out of all time worked. Do the calculations and see if your gross pay equals what's on your check stub. I'd do this for about 6 months.

If you find errors bring it to your employers attention and if they aren't willing to make corrections, contact your states department of labor.

If any other employees are having the problem go as a unit to your employer !

If you're absolutely sure you're being cheated, the Department of Labor would be interested in hearing from you:

You don't say how they are cheating you...
FIRST
Check your local/State labor board regulations for OT qualifications.
(with the way some states have changed labor regulations, it can be confusing as to what Qualifies OT hours and what doesn't).
After checking and you find you ARE entitled to OT, make sure you have documented data,i.e. copies of time cards or sign in sheets. Calmly and professionally approach your supervisor with the data and state, ''There must be some kind of over site or mistake.''
Explain to them what you have found and calculated, wait for their responds.(about 1-2min.)
If they agree with you, ask them for a time frame for restitution ($$) to make you whole.
If they disagree with you... make sure you are absolutely correct(!).....
Let them know you are sorry they can not resolve this, but unfortunately they will force you to go to the State Labor Board for resolution.
(Companies hate the thought of the Labor Board doing an audit)

Please note: if the company is Intentionally cheating their employees out of OT... You know without saying, they are not a nice company... things will get Nasty.. be prepared to quit.

Call the labor board in your city/county and start tracking your hours worked compared to the hours paid.

You can contact the state or federal Department of Labor. Overtime is federal law. Every state has to pay at least time and a half for hourly employees. It doesn't matter if you are in Kentucky.

Even though they aren't supposed to retaliate against whistle blowers, they do (they are supposed to pay OT but don't) .Be prepared and keep a good documentation of the hours that aren't being compensated. If you make a complaint then you will have your ducks in a row.

Good luck.

employees are cheated out of regular pay by them being fired before payment, out of bonuses they are entitled too, hours worked by not paying them all of their hours, cheating workers out of their gratuity money by putting the gratuity under service charge to customers and not paying the employees
