They said i failed the probation which was not in my written contract that i was on one only said to me in conversation, i have failed my probation they said for not using eye contact and smiles to customers which i did and that i dont stand out which i think is really unfair and dont mix and talk to other staff which is also untrue. Can a employer really do this? I have worked for the company on and off for 12 yrs but this was working in a new store so i new my job well but started again on a new contract after leaving a few months before. |

Sad, but you are out of luck. It would be hard to find an employer that does not include an "employment at will" clause in their contract. Basically it means, they do not have to have a reason to let you go. In your posting, you admit you were told about the probationary period, albeit, verbally. Unless you can prove they let you go outside the probationary period, you are out. At any time during the probationary period or at the review for it, they can let you go and give you no explanation at all. Sorry for your troubles but most likely there is nothing you can do but move on. |

I'd contact your union rep. or contact Citizens Advice for legal advice but it seems to me that they just wanted rid of you (personality clash with the manager).

Usually there is a 90-Day probationary period. The employer can dismiss you for any reason, except for race, sex etc.... |

In the UK, if you have been employed for less than a year, an employer can dismiss you for any reason (apart from discrimination) and you are entitled to one week's notice. Probationary periods have no basis in UK employment law - they are just a management tool to help assess an employee's skills when they first start.
Your only recourse may be if your contract of employment states that your previous employment with the company counts towards this employment. |

I would take this matter further.
If you have been relocated to another store and haven't been told you were on a new contract with probation then they owe you a little more than that.
If you did start a new contract then 1 week is the answer to that. |

If your in the UK, yes i'm afraid it is true. They only have to give you 1 weeks notice, but some ask you to leave there & then. Its an unwritten rule about the probation, these days all companies do it.
If you go & see the CAB, they will clarify this for, & its free.
