What is the overtime law in alabama?

Conan the Librarian
The only overtime law on the books is a Federal law established by the U.S. Department of Labor. It covers every single state in the United States. Here is is:

The Fair Labor Standards Act (FLSA) of 1938 establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. Covered nonexempt workers are entitled to a minimum wage of not less than $5.15 an hour. Overtime pay at a rate of not less than one and one-half times their regular rates of pay is required after 40 hours of work in a workweek.

Here is a link to the entire law:http://www.dol.gov/esa/regs/statutes/whd/FairLaborStandAct.pdf

TIME AND ONE HALF

cyanne2ak
This depends upon the age of the worker. 18 and over msut be paid overtime for any hours of 40 UNLESS they are salary, or management. The same is true for under 18, HOWEVER if they are enrolled in school, federal stipulations apply. Also, overtime does NOT apply to contract labor or agricultural labor (e.g. migrant farm workers).

There is no overtime law in Alabama.

brothergrimiam
In alabama the law states that the time that is spent with animals in the barnyard setting applies as overtime. When you date them, that does not apply.

jeremy1952
Federal law applies in every state. Any hours worked over 40 in a given week must be paid at time and a half, unless the employee is exempt. A company can set their seven day week however they want for overtime purposes, BUT they cannot arbitrarily change it; so if you're checking on your pay you need to ask what their "work week" is. Sunday to Saturday is the most common.

State laws can be MORE generous to the employee than Federal, but not less; the only state substantially different that I know of is California, where any work over eight hours has to be paid at time and a half.
