It depends on the product and what regulations there are. SOme products have a "Sell by" date, which precludes the store from selling after that time. Others just have a "best if used by" date, which does not mean you can't sell it or use it after that date. Milk and dairy products, for instance, are more strictly regulated than prepared foods (boxed cookies, cake mixes, etc.) It is up to you to pay attention to what you're buying. If the store hasn't taken outdated items off the shelves, especially in the meat or dairy case, you should bring it to their attention.

They don't. They should not be selling anything past its sell by date. Have a chat with your local authority Environmental and Consumer Protection Department.

With all the items you find in a grocery store, you will occasionally find and out of date item. As people shop they will grab the newer stuff that is at the back of the shelf and leave the older stuff there. Just go tell the manager or service department and they will correct the problem, Simple as that.

I had no idea that they did!
Most food have either a sell by date, which as far as im aware it cant be sold after this date (a local shop keeper got fine for selling products past there sell by date) or a best before date which is exactly what it says, the food is at its best if used before this date.

However things like yoghurts tend to have a much longer shelf date that is stated on the product.
I think it is a case of buyer beware but im suprised that supermarkets would sell food that is out of date, whcih supermarket was it?

No company that sells perishable products to consumers has the right to sell out-of-date products to anyone. The legal ramifications as well as the bad publicity could put them out of business. I would take the product back with the reciept and demand my money back. If they refuse, your local news reporters would love to get a hold of a story like this. Better yet, the company whose out-of-date product they sold.

Depends on the date being used. For sell-by and use-by dates, there is no defence. It is a offence under the Food Safety Act 1990.

Best before dates are more advisory, and so you are likely to find these discounted, but they should be labelled as such.

People like Tesco can do whatever they feel like, they're so big and wealthy that they can ignore whatever rules they care to. Besides any store can sell out of date stuff as long as its marked as such.

i bought a smoothie from asda today (29/01/11) and just realised it says best by 26/05/10 . I was so shocked but i guess it was just a mistake
