I purchased a ipod touch off ebay on January 6, 2008. Today I received the item and was not the product described. It was a fake chinese knockoff, not second generation, and not in mint condition. I had a itouch before and I know the difference. Also, itunes does not recognize the serial #. Here is the link....

For a first step, I would contact the seller and tell him exactly what you've said here, and ask to return it for a full refund.
If they do that, it was probably an honest mistake on their part.
If not, Report it to both eBay and Paypal (if you used them) as fraud. They supposedly have some lengthy process to get most of your money back.
I'm afraid you've learned a tough lesson though. eBay really is the wild west of buying and selling. I really hesitate before buying any merchandise on eBay. And even then, only from sellers with lots of transactions and a very high positive feedback rate. |

First off, if you haven't already, I would contact the seller. If that doesn't work you can open a case with ebay and tell them what happened. They have you send them an email explaining your problem. If they side with you on your case, they'll most likely refund your money. I did this one time when I payed for something using paypal and the next day the seller's account was deleted because of stuff they were doing. So, I opened up a case with ebay saying that their account was deleted and I didn't get my item. They gave me a refund. |

Before buying on ebay, check the last 100 or so transactions on the seller's feedback profile. That will tell you how that seller has treated other buyers. |

Well firstly email the seller and see what they're reply is. Then contact ebay about how you received a fraud and give as many details as possible. Do you have previous emails from the seller? Keep all records of what you've sent or received.
How did you pay? If it was Paypal open up a claim explaining as many details as possible. If you paid by check, ask your bank is it possible to claim or cancel it.
Finally if all else fails see about contact the cops and give them them the sellers details and explain what has happened. Either that or contact Apple.
Just get in touch with eBay and they should point you in the right direction. If not follow the above. Hope this helps :) |
