What should an EMPLOYER DO IN THIS CASE regarding unemployment???????
a friend of mine is a partner in a corporation and his secretary was recently fired for stealing a large amount of money over the past few years...

now the secretary is trying to collect unemployment. but she will not get unemployment if she was fired for stealing right?

what should the employer do when it comes time to answer to the umemployment office? to tell the truth and let the secretary get to unemployement money?

or do not answer questions from the unemplyment office so that the secretary could collect unemployment money?

what would you do? what is the legal way to do it?

Excuse me, she stole large sums of money from her employer and has the chutzpah to apply for unemployment? Unemployment compensation is for people who were fired without due cause; stealing from your employer is a prime example of due cause. Has this idiot considered that she can be imprisoned for that? In fact, in some states lying in attempt to collect unemployment is a felony in itself.

I would have gotten my evidence together and filed charges against her to get her sorry butt in jail. End of unemplyment problem.

If the secreatry was fired for a legitmate reason like stealing then your friend has nothing to worry about. I hope that he has some kind of documentation or other proof the he had her sign when he released her just in case he needs it. It is his word against hers. But most likely if she stole there she has done it in other places. So investigate on a personal level. Also he should tell the truth because if she claims unemployment on him his unemployment taxes will increase causing his unemployment liability ( the money he pays) to increase. Don't let that secretary steal anymore than she already has. She is lucky he didn't prosecute. Good Luck!

The answer to unemployment would be that she was fired, the reason why and that alone would deny her unemloyment benefits...as I am sure there is stated in employee handbook that stealing is not allowed.
Besides..the secretary should be happy that all she did was get fired and not turned into authorities for embezzlement

if she got fired she can not collect unemployment. if she was "layed-off" she can. when filling out the application for unemployment she ahs to mark one. but i believe her ex-boss can contest it if she lies.

I would tell the truth to the unemployment people. A person shouldn't be rewarded in anyway for stealing. This secretary is lucky not to be in prison. Unemployment comes from the tax-dollars of honest, hardworking people. As one of those people, I would not want to be giving money to someone who was fired for stealing.

Depending on what state you are in, you can take her to an unemployment court and show proof that she stole. If you can do that the committee SHOULD deny unemployemnt benefits. Sometimes it doesn't work out though - its basically at the whim of the unemployment committee. Technically she should not receive unemployement benfits since she was fired for cause.

The unemployment office will contact the company, the company can put the reason and refute the claim to any unemployment. There can be a debate but basically they will probably win if there is proof she stole. She would be foolish to try and collect as this can hurt her if it all comes out. She is lucky they didn't press legal charges, so to answer, yes she can file, can she collect, they can fight it.
