Man, that sucks. You'll have to pay it back. Technically, if you knew it was happening for five months, you've been stealing from the company. If you don't pay it back, they could press charges in criminal and/or civil court.
Just like the couple who deposited a check for $750 into their savings account and the bank mistakenly deposited $750,000. They emptied their savings, quit their jobs, moved to Florida, and bought a house. The bank discovered their error, demanded their money back and the couple was charged with grand larceny. |

The simple answer is that you do the same thing that you would do if they underpaid you due to a corporate mess up. If you were shorted instead of overpaid, you would expect the company to make good. Since you were overpaid, you should make good. I assume that you knew they were making and error and did not tell them.
I suggest that you work out a deal with them to pay it back over a period of time. |

Depends.
They gave you the money.
If you want to keep the job then give them the money back.
But if you can find another job you like or another job that pays well
then tell them whatever you want.
Of course there is still a chance they could take it to court.
Get the 13,000 dollars, and then fire you anyway.
So you'd end up without a job and a loss of 13 grand.

Pay it back, and hope you keep your job. Usually you will be fired in addition to having to pay it back, for being dishonest. Next time you notice a paycheck discrepancy, tell your HR department immediately. |

Personally I don't think they can make you pay this back it is not your fault they messed up. However, if you noticed that the checks were wrong you should have went to the manager or someone to find out if your check was in fact made out right. If you didn't know that the checks were wrong until they came to you I would advise you to get an attorney because if you are working on commission then it is the companies responsibility to be sure you are paid correctly for your commissions. I would argue the case as I was under the assumption that the company knew what they were doing and when they made out my check they should have known how much to pay me in accordance with the amount of sales for commission. Obviously the company has very poor organization skills for this to have gone on for 5 months. I would not stay employed with this company I would find a new job and get yourself a lawyer. |
