In your example, "Best Widgets" is the company's assumed trade name and must be filed for in the state ABC Corp filed its corporate paperwork and the states it will do business in. This locks the name "Best Widgets" for them. If they want to lock Best Widgets, Inc. they would file for that assumed name also. If they do not file this paperwork, someone else could also do business as "Best Widgets" in their trade area. In your example, Best Widgets is not the corporate entity, ABC Corp is.
Individuals and partnerships can operate under an assumed trade name also. As they don't file paperwork on the state level, they merely lock and protect the name with the county clerk where they are located. Their filing is usually valid for a period of 10 years. So a hypothetical Joe Smith who has opened a business established as "Joe's Car Repair" can't have another person enter into their market and open a business under the same name. |

becoming incorperated takes alot. you actually have to apply and fill out all sorts of paper work and show stats of your companies yeilds, ect. thats why my company is an LLC. Limited Liability Corperation |

In order to use the INC. a company must register itself as a corporation. There are several kinds of methods, inc is just the one for a large company. There is DBA, "doing buisness as" for independant contractors...there is LLC for a small buisness, that only holds them responsible for as much money as the LLC has, and then there is INC for larger buisnesses, that allows them to benifit from all the Bush-like tax breaks....Hope that helps! |

There really isn't any difference between a company that is labeled as a Corporation or Incorporated; they mean the same thing. |
