When there is a criminal and civil investigation can a secretary be charged with what the bosses are doing?

If the secretary knew what was going on and it was criminal, she could be charged with conspiracy or aiding and abetting, or abetting before and after a crime. If she withholds information from the investigators, she could charged with that crime. If she profited from her part in the criminal work (like getting paid extra under the table), it could get worse.

If the criminal activity invoved the possible death of a person, she would have a reponsibility to report it to the police or to the person who was the target.

Chances are she will be able to get immunity if she cooperates and has useful information. She should get her own lawyer as soon as possible. She may be entitled to a lawyer paid for by her company.

If the secretary knows of criminal activity on her boss' part, and does not report it, then, yes, she can be charged as a conspirator.

The answer here is........YES. If the secratery KNOWINGLY goes along with the boss' plans to do whatever it is that he is doing, he/she too can be subject to the legal ramifications. Even if the secratery does not participate in the actions, but KNOWS about them and fails to act accordingly(ie: report the boss to the proprer authorities) he/she can still be subject to the criminal/civil ramifications!
