Why is a company held responsible if an employees works with out knowing?

Additional Details
A department hires someone to work and Human Resources doesn't know anythig about it? What happens if this person gets hurt or liability wise?

How is it possible for a department to hire someone.

normally, the department tells HR to hire them. then HR does the paperwork, forms and tax information.

I dont think this is what happened.

The company needs to have better hiring strategies. If I am hired by a company and fill out all the appropriate paperwork, the HR department would have to get that paperwork in order for me to get a paycheck. If I filled out all that paperwork, I am an employee, entitled to pay, and am covered up the employer's liability insurance policy.

If the person had signed his or her name on a document stating they were highered, or received a time card, or has witnesses of them training and/or working, then they are in fact an employee of the company. Then the company would be responsible. Just because HR was not involved does not mean they are not an employee. It just means that proper procedures were not followed when the individual was highered.

Unfortunately, miscommunication occurs frequently in the office. HR is one of the departments that hears about everything last. It shouldn't be this way, but it's life.

Yes (and no). Keep in mind that unauthorized work is very legitimate grounds for immediate dismissal.
Why? b/c they are required to pay you for that time and will likely be on the hook if you are injured or injure someone.

If you were working w/o 'permission' and an injury occured, the biz would likely fight it by saying that you were not working (especially if this occured off premises).

Why is this the case? Liberal attitutes towards employers says biz is responsible.
