I refuse to shop at Wal Mart for this! I'm just very saddened that this family has to not only lose her son but this multi billion dollar company would go after her little money? They should be paying HER for losing her son!!!! This is tragic ! Please boycott Wal Mart!

I admit, what Wal-Mart is doing here sucks. As for their claim they are doing it out of fairness to the other people who contribute to and benefit from their service, I say write a form letter and explain this woman's circumstances. Give them a chance to vote on it. I'll bet the vote would be very close to unanimous to let this woman keep her settlement money. ( I know they won't do this, but I'm trying to make a point)
But if we boycotted every store that did crappy stuff to people, nobody would ever shop. They all do something crappy to someone sometime. |

Um. They're not going after "her little money". She was paid benefits by her company's medical plan when she was hurt in a car accident. Then, some time later, she won a lawsuit which included a settlement based on the cost of her medical bills. So the insurance company, which had paid some of those bills already, wanted to get back the money they had paid out for those bills.
It's tragic that her son died. But that's *completely* irrelevant to the point, which is that insurance policies are written with certain standard clauses in them and they award settlements in certain standard ways and they recoup from each other according to certain standard methods. This woman's case is unfortunate, but trust me -- a boycott of WalMart won't change the way the insurance industry is run. |

Wal-mart's benefits dept is doing exactly what any insurance plan is supposed to do. I would bet that everyone who receives this much money in a settlement from a car accident has a sad story like she does. Companies have to follow the rules of the policies and plans and cannot just give out money to whoever has the saddest story. If Wal-mart just gave her the money everyone with a settlement for medical bills would want the same, and they would be bankrupt. The death of her son, though sad is irreverent to this decision. The court would not have allowed it if it was not proper. |
