Okay, two months ago at work I was chatting privately with a female co-worker/friend about sex while a male co-worker overheard. I brought something up to his attention today about his work ethic (he was yelling at our timid manager) and he retaliated with yelling at me saying that he was going to call our HR department on me because I was talking about sex to another employee on work time and that he was offended. He claims this was sexual harassment.
Do you think he'll really call HR on me? Would they really believe him if he's our problem employee? (He's the reason our manager is taking heart and depression medication!!!) |

He sounds like some one that might just do that. However, if he were truly offended by the conversation between yourself and your co-worker, he should certainly have said something to you, your co-worker or your supervisor before now. I doubt seriously that he would be believed. The law being what it is, and if he were to call HR, there would likely be a casual questioning of all concerned. I wouldn't worry about the troublemaker. |

I doubt he has grounds to make a sexual harrasment case, afterall he overheard your conversation you werent talking directly to him. Also if he is such a trouble person why dont you go over his head and approach HR yourself, he seems to be a troublemaker anyway. Even if he does call HR on you, I dont think they will believe him, also such people always let their reputation precede them, so maybe your HR dept. knows he is an annoyance. |

No, he cannot call HR on you any mroe than he can call S.W.A.T on you. If he was uncomfortable with the conversation then it's his resposibility to either leave, or voice his distress so that you may stop the conversation. |

If the scumbag feels his job is threatened he will lash out at whoever he can to save it. Will they believe him? With his track record, I doubt it, but your best bet is to turn it into his word against yours if it comes to that.
The sexual harassment laws that are out there now have swung clear into the Red range of stupid. So it goes to show you, any conversations like this you need to make sure they are private and only with real, true friends. (Not just "work friends.")

He most likely will report you. it sounds like he has some mental issues if he sits around all day plotting out ways to make other people miserable. just report all of his behavior to HR and have your coworkers do the same.
what he said to you sounds like blackmail to me ("don't talk bad about me or i will get you fired for so and so").
he has created a hostile/uncomfortable work environment. your company must have a policy on that.

Sorry, but you shouldn't be talking about sex at work. Your idea of a harmless sexual chat with a co-worker is obviously someone elses idea of a hostile work environment. And since he overheard, it obviously wasn't as "private" as you think.
He has every right to be offended, and he probably will call HR and report the incident.
