They have filed a complaint with my local magistrate, and they are asking for over $4000 which is the amount that has accumulated over the years in late fees and interest. I don't feel I should be liable for that much money, since it was a student credit card that had a limit of $500. |

Every state has a statute of limitations on debt. The SOL is how long a creditor has to seek legal remedy for an unpaid debt.
You need to find out what the SOL is for your state and repspond to the court with this defense if it has expired.
More than likely it has, so you should check the summons and find out the process on disputing the debt.
You must respond and/or appear in court. If you do nothing, a default judgment will be awarded in the creditor's favor, whether or not you really owe it.

Ya know what's interesting about these answers?
Two of these folks are collection agents...and the very first thing they state is "No, you don't have to go".....
They have lies and deceit so embedded in their brain they just can't help it!
If you do not go to court and fight this, the collection agent wins by default. No proof, no evidence.....the judge just rubber stamps "DEFAULT" on the judgment and you now have a garnishment on you.
The last thing in the world a collection agent wants is for you to show up in court.
Even worse, they don't want you to show up knowing your rights, and understanding the Statute of Limitation laws. Unless you tell the judge that this debt is beyond the SOL for your state, you lose again.
So I strongly suggest you do a bit of research on this...GO TO COURT...and demand that the creditor prove their case.
By the way, I can guarantee that most of those fees are illegal. Again, unless you challenge them they will be awarded to the creditor. |

Yes unfortunately otherwise they will probably reposses items you own and auction them off.This is called the 7 year itch they have 7 years to claim these things and time is running out so this is why they are taking you to court if you are working they can also garnish your wages Id go to court so you can workout a payment plan |

You can file a motion or response to the suit stating that the statute of limitations has expired for them to sue you for this debt.
Or, you could go to court and argue that the statute of limitations has expired and ask that the suit be dismissed.
Or, you could go to court and make them prove the debt it yours, what the debt is for, how it was calculated, that they own the debt and that they have the right to take you to court, etc.
Basically, the are expecting you to not show up or not present and arguement and get a default judgement or for you to contact them about settling the debt.

No, you don't have to go. If you don't, the judge will only hear the creditor's side of the story and consider their story to be honest, fair, truthful and complete, because there will be no one there to tell your side of the story.
The limit is a limit on what they will let you charge. It does not limit their right to assess interest and fees that you agreed to pay hen you applied for the card. By making them go to court, you are causing them to incur attorney's fees and court costs, which they also have a right to add to your bill. |

I agree it's a big rip off. After 7 years if you write to them and ask them to remove from your credit report, I think they have to unless it's something like a government loan. Sometimes you can get them to negotiate. But if you already have a court date and interest has accumulated, they may get a judgment against you. Do you have time to consult with legal aid, if you can't afford an attorney. Or if you can just afford the consultation fee for the attorney, that might be beneficial to you. Good Luck! |

No you do not have to appear, however if you don't it's an automatic judgment against you & they can then garnish wages etc. Best thing to do is contact the creditor or attorney & ask for a payment plan instead of going to court. They may even settle for less than the balance. Make sure you can meet any agreement you make & get it in writing. Don't give your bank info. |
