A collection agency is demanding payment for a credit card I never had!?
Federal Pacific Credit Company of Utah is demanding payment for a credit card I never had. I wrote to them and asked for verification directly from the "supposed" creditor and they sent me a bogus affidavit signed from the president of their own collection agency NOT from the actual creditor! Is this valid? I wanted actual proof from the creditor and they failed but presented an affidavit. To me, that is not proof. Anyone can write an affidavit. What are my rights? What can I do?

You can spend all your time writing and going back and forth but the easiest way is to save all paperwork and ignore them.

Don't speak to them, they are junk debt collectors and usually try to collect a time barred debt. They have no legal recourse except to harass you. If it were a legal debt, they would have taken you to court by now.

If they show up on your credit report, just send copies of your request for verification to the credit reporting agency and copies of what they sent you. This will get the item removed from your report. Make sure they don't try to re-date the debt either, that too is illegal CITE: 15USC1681s-2

Write to them telling them to either provide the original contract with the original creditor or take you to court, and to stop calling you. If they cannot produce the original contract they have no leg to stand in court. We are handling a case just like yours.

You need to obtain a copy of your credit report. Everyone is entitled to one free credit report per year. Either you are a victim of stolen identity or someone is scamming you. contact your local BBB as well.

if you are confident that you never had this card then tell them that you are going to report the matter to the state attorney general's office.

that should make them run away.

but please make sure to obtain your credit report from one of the 3 agencies who by law are supossed to give you one free
of cost once a year

your credit report will show if you had this card or not

I had the same problem. They gave me the name of the creditor, I called them up and they verified I wasn't the idiot that they were trying to collect from.

They must give you the name of the company that they are trying to collect on. You can also have them verify the SS number, or previous addresses. I'll bet they just did a name search in the phone book and there you were. Since the SS numbers won't match, tell them to take you to court with the SS number of the person who they are trying to collect on, and then see who is the idiot.

Additionally, I would check on your credit report to see whether this is a case of indentity theft.

Send them a certified, return receipt letter requesting VALIDATION (not verification). Indicate that you never had the credit card and the debt is not yours. Request they include copies of the contract or any other document that proves the debt is yours. If they cannot provide this kind of proof that the debt is yours, they should cease and desist contacting you about this debt. Give them 30 days to respond.

Chances are you'll never hear from them again. But check your credit report to make sure they haven't put it on your report. Dispute the item with the credit bureau, that it's not yours and the creditor failed to validate. Attach a copy of your validation request.

send them a cease and desist letter they have to abide by it and not contact you any longer it simply states you will only deal with the original creditor. In the meantime get a free copy of your credit report at www.annualcreditreport.com if you would like the wording for the cease and desist letter email me at fort_bragg_girl@yahoo.com and i will copy and paste for ya.

Call them immediatley! By law you have 30 days to dispute & they have to provide proof of debt. They haven't done that. Ask for the manager at the collection agency & insist on proof. Good luck!
