I usually pity people that find work with collection agencies. I had a boob from a collection agency telling me that she was a lawyer, she was lying.
Try and pay the company that you got into debt with something...$5 a month say? Do not pay the collection agency anything. Nothing. |

Well, they better follow through. They cannot threaten to sue you unless they intend to do it. It is against the law for them not to follow through. Because the law says that you cannot say to a person that you are taking them or are about to take them to court unless an action or motion is already in progress. If it appears that it isnt you could sue them for mental distress and you might win.
The funny part is $200 is about the cost of filing a motion in court. It would not be cost effective because they might loose and would have to eat the filing cost lawyer time, etc. They can sue and include all their fees and if they win that amount could be $1500 if you loose. |

Whether they sue you depends on a couple of things. Mainly, where is the collection agency located? If it's a local agency, then the cost of them going to court is not that great.
Lets do the numbers.....For example, in Michigan they can file a Small Claims for $25. You will end up eating the court costs and legal fees, IF the judge awards them (they don't always do that). For all that trouble, the collection agent only gets a percentage of the money (many times 30%). So with all of that time invested, they will receive $65. They probably had to invest several hours of work to get this, with all the paper work and court appearances.
If you owned that collection agency, would you approve of your agent spending 8 hours of time getting $65? Of course not! It's far cheaper for them to make a few dozen threatening phone calls, maybe a letter or two. Did you know that it's illegal for them to say they are going to sue you and don't follow through with it?
Now, that's a local agency. It's gonna be far worse for an out of state Agency. I'm sure some of the posters here who are collection agents would like to weigh in on these comments, right guys?
It's far more likely they will not sue you, and be happy to just mess up your credit rating.
My suggestion, for such a small amount of debt, is this.....
-Quit talking to the collection agency, and contact the original creditor. Unless that agency purchased your debt outright, you have no legal obligation to even talk to them. Make an offer to pay a monthly payment of whatever you can afford, for a total of $150. That's what they will be getting from the collection agency anyway if you paid them.
-IMPORTANT! Whatever you do, make them agree IN WRITING to remove any negative credit information from your history BEFORE you pay anything. You are trying to protect your credit rating, so why would you pay them and still have a bad history?
Before you start fighting with these guys, you need to study the law and learn your consumer rights. Read the links below, they will help you a lot. |

SUE is a tactic, BLUFFING is not exactly correct. $200 can damage your credit rating as easily or intensively as $20,00o owed and unpaid.
The agency bought your debt perhaps, if it isn't the orginal org that you owed to, and may in fact sell the debt often or over the term of the debt, until it's paid.
You will be hounded for years no matter the amount and they wil accept payments you can afford if you feel the responsibility to pay for something you commited to pay for.

they're bluffing. it's just a gimmick to get ur response. i got 5,6 of those letter and i just throw it away. of course i got bad credit. all they do is report u to the credit agency and ur credit is on hold or ruined. but sue u? haha, yeah right. don't worry about it. if u can pay it, pay it. if u can't, all u end up is with bad credit. it's only $200.00. |

YES, they will I have seen places sue for $20 and even less. Call them and make arrangments to pay them off, even if it's only $20 a month, if they are getting something and they see you are making an effort they should work with you. |

Court and lawyer costs are more than 200.00 for collections.
It's a scare tactic, but you really should pay-up. A collections mark on your credit score is going to cause thousands of dollars worth of pain down the road. |

Listen, the smartest thing to do in this situation is to pay what you can, EVEN AS LITTLE AS $5!! In this case they can NEVER sue you because all you have to do is show that you are trying with your $5/month payment and they would throw it out. The companies KNOW this so they won't even sue. But remember your credit rating will suffer and you got to ask yourself, what is more important, your credit rating that may one day prevent you from pursuing a lifelong dream such as home ownership or buisiness ownership, or having that $60/month cable bill and $200/month nasty nicotine habit? |
