They do this stuff every day and have an answer for everything. I just need to buy a couple of weeks so I can finish getting the money together.
For the most part, the debt is valid. While I haven't verified the exact dollar amount, I do acknowledge owing money to the orignal party. I want to get it resolved.
I was disappointed to find the account was turned over to a collection agency. The actual company I contracted had received a retainer from me. Every time they called and requested that I add to it, I payed them promptly via credit card over the phone. Once the job was complete, they turned over the account to the collection agency without a single phone call.
Does anyone know if I have a legal obligation to pay the collection agency? I'm sure they keep for themselves a significant chunk of the money. Because I agree that I did receive something of value that I need to finish paying for, could I pay that initial company directly? Additional Details Of course, they are threatening to sue. I told them I would call them back today with my checking account information. It wasn't until I got off the phone and had a chance to think about it that I realized that would be a very bad idea. Because I originally payed by credit card neither one has any record of my checking account number.
I have a less than an hour to call to keep my word. |

Do Not give them your info. They will settle with a lower amount and most legit collection agencies give you 30 days on the debt to pay. And not encouraging you to not pay but unless its a very big amount they usually do not sue. Also make sure and get it in writing that they are going to delete any info they reported to the bureaus. They say whatever they can to get you to pay but if you do want to pay they will take a money order!! |

NO...NO...NO....For the love of God...DO NOT give them your bank transit + checking account #!...This is the worst possible mistake you can make when dealing with debt collectors..
If you pay them....get all terms IN WRITING FIRST prior to giving them one penny....If they refuse a written agreement about exactly how much is to be paid....don't pay them......Pay only via USPS money order.....Absolutely, positively do not give them your checking account #....unless you want them to raid every penny you have and get bounced check fees.....
Even though you may owe this debt....do not acknowledge this in writing.... |

DO NOT and I repeat DO NOT give them ANY information regarding your checking or savings account. If they are a legit company then they will have to go through the court system and put a garnishment on your wages but you never EVER give out that kind of information to anybody. |

Unfortunately, even making a promise to pay may make you liable, especially if they sue you. The collection agency owns your debt now. However, if they sue you, they have to prove that they own the debt before a judge will grant them a judgment against you.
I don't understand what you mean by a retainer? Could you clarify that? If you've already paid off the original creditor, then I don't see why they would have sold your account unless they want to double dip - that is take your money and get a tax break by 'charging off' your debt.
If you decide to pay the collection agency, get an agreement in writing that they will delete this negative item off your credit report if you pay them in full.
Don't give them your checking account number and don't pay them with a personal check if you can help it. Use money orders so that they don't know where you bank.

Call and tell them you don't have the money and will not give them your bank account number. It will take time to sue you. You can have the money and pay off your debt before you have to show up in court. |

Your instinct is correct. DO NOT give your checking account number to them. Repeat to them that you are getting the $$ togther and will have it in a couple of weeks. Then don't talk to them anymore. Get their address if you don't have it, and screen your calls until you get it paid.
Unfortunately, you do have to pay it to the collection agency. |
