I'd have to agree with engineer. I think engineer's answer makes the most sense.

If you don't have any paperwork, she could lie in small claims court and then your are out of luck. People lie in court all the time and for the most part nothing happens to them.

Also, it's one thing to win a judgment against a person and it's another thing to collect on that judgment. Many people just refuse to pay. It's a difficult situation.

Well, you learned once you give a friend money, they are no longer your friends. If it's a small sum just get over it. If you lend some one money in the future, just write the word loan on the check instead of the persons name.

Without a written commitment, you are out of luck. Small claims court will be a waste of your time and actually cost you more money.

Again, without some sort of written agreement you are in trouble. Verbal contracts are binding, but your friend can simply say it was a gift.

You have to remember that the burden of proof is on you. So you have to decide if the "proof" you have will be enough to convince a judge.

If it wasn't alot of money, forget it and don't ever let her borrow money again, she is bought and paid for by you. If it is alot, I hope someone was with you when you gave her the money, it's her word against yours. You could try small claims court, fill out the necessary paper work and take her to court. But it is a long drawn out process so be prepared for it. This is a friend I would diffidently keep at a distance. It is income tax time, try to approach her again, and explain to her that you really need the money, tell her she can give back to you when she gets her tax returns, that way she'll still have money for herself and you'll have yours, get it in writing this time in case it doesn't then you'll have the paper work for small claims court. Hope it works out for you.

If you can prove it with witnesses or if you can get her to admit it, you can take her to small claims court.
Next time, trust you friend but get it in writing.

go to small claims court...it doesn't matter if you had a written agreement or not. If your friend has a job then you can get your money back.
