Hello, My brother moved out about 3 months ago. I get these phone called evey day asking for him and i tell them he dose not live here anymore, stop calling here. I did stop for about 2 weeks, then i got a call from this guy asking for him again, i told him again he dose not live here. This guy then told me that he is in serious trouble and i am a lawyer. He then told me he ows 5k to a credit card company now. Then this ****** said told me my name address ect. and then treaten me. he said if i am not telling him info where he is ect. and if i am screening the call he would have me arrested. I was scared and gave him his cell phone #. he then told me i did the right thing and he would not have to file a case with the FBI. I have never delt with any of these fine folks. i have his # on caller id and its a 1-886

You did the right thing posting a question on this forum. good luck

I would seek advise from a lawyer. Sounds like some privacy issues were violated. Why did he feel it necessary to give out your brothers info to u . Its none of your business.

They have no legal right to bother you. I went through the same thing about 2 years ago, right before I got married. Just keep telling them that he no longer lives with you and you don't have a forwarding number. You have no legal responsibility for your brothers debt. It's legal to screen your calls, no one can tell you not to. Tell them(if they call again) that they are harrassing you and you will file a complaint against them with the better business bureau and the attorney generals office.

Happy Little Trees
This is your turn to call a lawyer now to file a harassment suit. I am sorry, but they do not call the FBI for credit card issues!! If the FBI was so concerned, they would certainly show up at the house and question whoever lives there, not use a piece of crap to call on the phone. Make sure you have the number he called you with and consult with a lawyer right now. You cannot be arrested because of your brother's debt!!!!!!!!!!!!!!!!!!!!!!!!!!
Look in the yellow pages and you will see advertisements for lawyers that will give you a free consultation..Good luck and if that piece of **** calls back, tell him you can talk to YOUR lawyer.

It is illegal for him to threaten you about anything, nevermind withholding information. The only way he would be able to force you to give him information would be if he took you to court. The FBI would not be getting involved with a credit card debt (unless it was a fraud thing that he was involved with).

Did the guy give you his name? I'd say look him up and see if he really is a lawyer. Otherwise, if he keeps calling you, report it to the police and phone company. The phone company can actually block his number for you.

What he did was illegal. If this happens again you can file s Cease and Desist order against the companay harrassing you. Please consult a lawyer so you can know what all of your rights are. Oh yeah and the next time that happens, you can also file a police report with your local constabulary agains the collection agency.

He is a false attorney; just a debt collector calling for money. No attorney in his clear mind would have that kind of discussion with you. If somebody calls you and says he is a lawyer, always ask for his full name, what state he was licensed in, and his bar license number. He must provide them to you. Then send him to hell; he's not a police officer so you don't have to talk to him.
It is good that you have a caller ID and saved the number. Report them for unlawful business practices. Do not let it slip by/

What types of debt collection practices are prohibited?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact.

For example, debt collectors may not:

use threats of violence or harm;
publish a list of consumers who refuse to pay their debts (except to a credit bureau);
use obscene or profane language; or repeatedly use the telephone to annoy someone.
False statements. Debt collectors may not use any false or misleading statements when collecting a debt. For example, debt collectors may not:

falsely imply that they are attorneys or government representatives;
falsely imply that you have committed a crime;
falsely represent that they operate or work for a credit bureau;
misrepresent the amount of your debt;
indicate that papers being sent to you are legal forms when they are not; or
indicate that papers being sent to you are not legal forms when they are.
Debt collectors also may not state that:

you will be arrested if you do not pay your debt;
they will seize, garnish, attach, or sell your property or wages, unless the collection agency or creditor intends to do so, and it is legal to do so; or
actions, such as a lawsuit, will be taken against you, when such action legally may not be taken, or when they do not intend to take such action.
Debt collectors may not:

give false credit information about you to anyone, including a credit bureau;
send you anything that looks like an official document from a court or government agency when it is not; or
use a false name.
Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, collectors may not:

collect any amount greater than your debt, unless your state law permits such
a charge;
deposit a post-dated check prematurely;
use deception to make you accept collect calls or pay for telegrams;
take or threaten to take your property unless this can be done legally; or
contact you by postcard.

first off if you said to quit calling then by law he should,that dont mean he will.and 2nd tell him to take it to court,and get a judgement if he is a lawyer.if he was a lawyer then he should know how to do that.and dont give them any info because you really dont know who they really are.if you are screening the call,thats you phone nimber and you phone,theres nothing he can do about it.you can file charges on him.check the number on the net to see who it belongs to.FBI will not chase a debt problem,he is full of crap.
