A resteraunt that I visit frequently (which will remain unnamed) has always charged me a "convinience fee" for using a debit or credit card. I didn't think anything of this, as I've been to places before like that, but I have found out recently that this activity is forbidden by credit card companies, and in some states, ILLEGAL!
My question is...how do I go about getting this place reported? I looked all over Visa's site and found nothing. Anyone know anything? |

The best thing I can think of is to go back to the VISA site; they should have an option for you to email them directly (Contact Us or something similar). Then, just explain the problem and send them the email. They will sort out where the report will go once they recieve it. Leave your own contact information in case they want to ask you any questions. |

I don't know if it's illegal.
Back in the 80's (when gas was $1.00/gal), the Big Oil companies tried to pass on the "merchants fee" by charging different prices for cash and for credit.
$1.03/gal cash OR
$1.07/gal credit.
The people went bananas, and then one company decided to go back to "cash or credit, same low price" (actually, they charged $1.07 for everyone), and their business skyrocketed. |

To correct some posters.
In the U.S.
Signature transaction =No surcharge charge allowed
Pin transactions=Yes they are allowed
A few states prohibit merchants from charging a surcharge no matter how the debit card is ran through.
A few banks still have a pin purchase surcharge. |

How much are your purchases at this restaurant? I know a lot of places charge a convenience fee for processing Credit/Debit card purchases under a certain amount of money as they pay for their service to process cards. There is a charge for every transaction. The service isn't cost-effective if they allow someone to purchase something with a low total.
The practice isn't illegal, its actually pretty normal. Most restaurants can choose to charge you a nominal fee for that service if under $10-20 (though I mostly see places that charge a fee under $10).
If you would like to pursue some type of action for your own peace of mind, the Better Business Bureau (BBB) has a website where you can file claims online. It actually worked out for me in a different situation - a place had overcharged me and wouldn't refund the money on top of making me wait almost 2 months for a pair of eyeglasses - I got my money back in exchange for them not receiving a bad mark with the BBB.
You could also speak to the manager of the restaurant and ask them what the fee is for and why it is charged.
Always handle something like that with the direct company first before going elsewhere. It looks bad if you don't. |

It is not illegal on the debit cards.
It's also not illegal on the credit cards if they call it a cash discount. That's why some gas stations can get away with it because they'll post two prices, one for credit and one discounted for cash.
So if the restaurant had menu prices and a note saying something like 3% discount for cash purchases, that would be acceptable.
However, if they are truly charging an extra fee, I would tell the owner/manager that you will no longer give them your business if they insist on this practice in violation of Visa terms and possibly state law. |

gas stations around here do that too. I am not sure about it being illegal though. having been in retail for some time, I know that the store pays a fee for being able to run transactions through the system to charge your card. Some companies didn't make that much money and it was cutting into the little profits they made (including mine) It was not forbidden by credit card companies, it was just looked down upon. Banks do the same thing for using their ATM the only advice for you is to just not go if they will charge you extra. You could try calling the police non emergency number and find out what the law states exactly in your state and county. They could then help you in going farther |
