Am I liable for the debt of my fiance in collections?
I am considering marriage, but my fiance has tens of thousands of dollars of debt in collections. She has been unable to pay her creditors since she is unemployed, but receiving retirement benefits to live on. Would I be liable for her debts if we were to marry? Can the collection agencies go after my assets? We plan to keep separate accounts after marriage. I have a good credit score and don't want to see it tarnished for love.

the debts before her marriage will not affect your credit score, but if you live in a community property state, whats yours is hers and whats hers is yours, so the creditors can come after your assists. not to mention, you can forget about ever getting a loan in your names. you need to get a good lawyer to sort out the particulars of your case, but most likely, you will have to put off marriage until the debt is behind her and she can show you that she is responsible with money.

No you will not be required to be liable for anything that is in her name. However certain states have different laws regarding common property and other asset issues that could result in leins or wage garnishments on her side in the future.

Debt settlement programs can help to reduce the debt in collections and rid her of terrible credit. Collection agencies are designed to collect debts but they can be harrassing and cause consumers to stop making payments and avoid them all together. If you wife does become employed and they seek an attachment of wages it can be pretty embarrassing at a new job to have a sheriff serve papers for a judgement or wage garnishment.

Good Luck and she is very lucky to have someone like you to gain advice from. Some folks would find it difficult to get into certain situations like this.

It's very likely that if the collection agencies find out that she's married, they'll start coming after you for the debts. You might want to have her sign a prenuptial agreement stating that you aren't liable for the debts she incurred before you were married. If you really love her and want to marry her, maybe you could sit down with her and help her to come up with a plan to pay her debts. Have her call the collectors and see if she can get settlements on some of the debts. Collection agencies are often willing to take 80% of the balance, if it's paid in full right away (so make sure she has the money to pay it).

If there are medical debts and your fiance had insurance at the time, contact the insurance company and try and see if there was a billing error. Insurance might still pay if the charge was recent enough, or the bill could be staledated in which case it might have to be written off.

Encourage her to try and find additional sources of income so that she can get the debts paid off quicker. If she's not willing to make the effort take care of her debts herself, you might want to ask yourself what her motive might be when it comes to marriage. And remember, any debts she incurs while you're married become your responsibility. Collection agencies don't care who they get the money from, as long as they get the money.

When you marry your credit reports will be linked. You may have a harder time getting credit or good intrest rates because they will see that your wife's bills aren't being paid.
Before you two marry, why not take her to visit a financial counselor or a consumer credit counselor?

I'd call an lawyer and ask, different states have different laws. Some states are community property states.

Yes. If you get married you will most likely become responsible for her debts especially if you get divorced. They will not be reflected on your credit report because you are not on the original accounts, but if they take her to court and get a judgment and garnish her earnings then it will impact you and, if you get a divorce you could be responsible for half.

My suggestion: Don't marry this person until they get their **** together. Marriage is just a legal contract. You can be in love without being married. I'd be very concerned about legally connecting myself to someone who has proven to be so irresponsible.

How is she receiving retirement benefits? Why is she unemployed? If she has debt she needs a job. Period, end of story.

Personally, I'd be out of there but if you want to stay, don't legally commit yourself until this is taken care of.
