Am I responsible for my husbands credit cards if they are not in my name?
Am I responsible for my husbands credit cards if they are not in my name? I just discovered that he is $23,000 in credit card debit. He didn't tell me, I found the bills hidden in his desk that he usually locks. He has the house in his name too. I have been trying to get him to eat healthier lately and he won't since he has a family history of early death from heart disease. I am on disability and if something happened to him, I could not pay that kind of credit card debt. I would end up in bankruptsy.

He doesn't have a will and we have a minor child age 3. He constantly mentions how he isn't going to live to 50 (hes 46) ...if I had known he was ready to "check out" there would have been no three year old. This is why I am so worried about the finances. Sometimes when people think they are going to die...they do.

Not unless you live in a community property State like AZ, CA, ID, LA, NV, NM, TX, WA or WI.

As long as you are not in one of those States his estate will be responsible for the debt if he were to die not you personally.

i would find out what the heck he's been spending 23,000 + dollars on !
If there is nothing to show for it, and you had no idea he was in debt by that much... it could be a sign of bad bad habits, cash advances spent on drugs, strippers, gambling, who knows.

If those underlying problems (if any) are not taken care of, you will never get out of debt.

you are not responsible for his debts; however, if they are unpaid and the credit card company obtains a judgment, they will attach a lien against his real property and/or bank accounts. You would then be affected if they foreclose on the home you are living in.

You are not responsible for his debts. However, upon his death, any creditors can and will make claims against the estate for those debts. The executor of the estate (most likely you) will be responsible for ensuring all debts are satisfied. The easiest way to do this to ensure he has life insurance. Let's think about this though.. 90% of companies today provide complimentary life insurance for up to 1x an employee's salary. Of course, I would recommend obtaining more, but we would hope his bills do not exceed that amount... You should convince him to raise the amount of life insurance provided through his job. Most employers allow you to buy up to 10X amount of yearly salary as a life insurance policy (premium deducted from paycheck - and much cheaper this way instead of buying it separate from employer)...

Otherwise, what others say is correct.. Insure him on up.. Hope that helps.. e-mail with questions...

no if the cards are not in your name now if he has life insurance they can file a claim on them best bet is to have him file bankruptcy and clear them off if not able to pay them off if he pays the min he will pay them off for over 20 years

If something happened to him, yes, you would be. If nothing else, i would take out an enormous life insurance policy on him so that you could pay off his debt, house, etc in a tragic event.
