danielrutherford | Any debt experts out there?!?!? |
I have had a judgement entered against me for an unpaid debt which has left me unable to get a bank account or any type of credit. This debt has now been paid off and cleared but how long will it take before this judgement is removed and i can get a new bank account?? |

The Judgment is held on file by the court for six years. what banks do is another thing. maybe you should try a few diferent banks |

Get a certifiacte of satisfaction (or letter) from your creditor, and send a copy to Experian, and ask them to note this on their records immediately. They will not cancel the entry (six years), but it will show up as a settled debt, and the bank should accept this. Not guaranteed, knowing banks, but you can do no more. Shop around the banks, then. They are not all bad, maybe just 99.9% of them! |

Unless you have some sort of fraud against a financial institution, I don't see why you couldn't get some sort of bank account. |

Hello,
(ANS) what I think you will find in reality is that now your debit has been cleared, although the details still stay on your credit reference history file (and the banks can & will want to check this) for a number of years. Whats actually VERY VERY important is that you paid the debit off, why? because the banks will see you cleared the debit and therefore you would be considered a lower level risk once again in terms of gaining future credit.
**NOTE: Banks & building societies, etc hate customers who have no credit history because they cannot assess what level of risk you represent. Even if you are wealthy, banks hate people like me because I don't use credit ever.
**So someone who has had previous loans, over drafts, taken out car loans, had or still has a loan on a property & so forth are a good risk. That risk is judge by your past spending patterns including debits & how they were cleared down in the past.
**In other words a debit thats now been cleared shouldn't now be a serious barrier to opening a new current account. However, the bank may want to know what security you have or if you have a guarntor who might back you?
**You are fully entitled to see or have a copy of your credit history file, you would do this by contacting one of the 4 major credit reference agents. Such as "Experian" they charge a small admin fee of about £3 to £4 for a copy of your details.
**A bank will want to credit score you again as a new customer, if they offer you a new current account with them. This scoring is done by looking at a number of factors a) where you live i.e. Postcode b) Home owner or morgage holder, or not c) employment status d) are you registered on the electorial register or not? e) past credit history and so forth.
**A new banking company might be far more sympathetic if you only ask for a normal current account but without an overdraft facility, or only a small OD level. & if you only ask for a debit card rather than a credit card (credit or lending will be the most sensitive area at a guess here).
**Be very very wary of companies like "Capitol one" or "Provident" who look for people with poor or damaged credit histories, they are always keen to lend to such customers but you end up paying rip off interest rates. These companies are ruthless in their pursuit of such clients. My advise for what its worth is avoid these companies like the plague and stick to one of the big 4 major high street banks.
Hope thats of use? Best Regards Ivan |

it takes 6 years to come off ur record, after the debt is paid,if u apply for any loans or anything on credit and u get declined then every time that happens it goes against ur credit history and makes it worse, also applying for a credit report can do that as anything requiring a credit check isn't good and goes against u. |

just trying to make a difference

you can usually get a bank account with most high street banks (even if it's only a basic one) if you have had a county court judgement recorded against you - do you have others from previous debts?
once you have paid the debt you need to ask the court for a certificate to confirm the debt has now been paid, then you need to notify the large credit reference agencies like experian and equifax, they will then update your credit record - it won't wipe the judgement off but just show that you have paid it!
any adverse credit, late payments, ccj's etc will affect your ability to obtain further credit - i mean why should other people lend you money if you have not repaid people you have borrowed from before? it's just common sense.
most people don't plan to get into debt - it often arises out of a relationship breakdown or job loss.
if you need help to stay out of debt in future try the Consumer Credit Counselling Service who are a charity who can give you free practical advice http://www.cccs.co.uk/budget/budget.aspx |

Judgements usually take 6 years before they are removed from your credit file. Would suggest you get a copy of your credit file from either Equifax or Experian (this costs £2.00) and see if this judgement has been entered as paid. If not write to the Credit agency, showing proof that you have paid the debt, and they Will enter it as satisfied. Do not understand why you cannot get a bank account, banks tend to offer basic bank accounts to people who have credit problems. You'll get either an electron/solo card, and there are no overdraft facilities on these accounts. Check your credit file to see if there is anything else that could be stopping you getting an account/credit,. |

Yes you can get a new bank account. I was in a situation where my husband was made redundant, we fell behind with payments on loans, credit cards etc and when things got so bad we went to welfare rights(similar to citizens advice).Just wished we'd gone sooner. As I already had a ccj against me then this was used to get an administration order. We were already customers of one bank and owed them in overdrafts etc, This was added to administration order, but before all this went to the county courts we were advised to find a bank that we could use for getting money paid in, with no o/d but with easy access to our money. We tried several banks upon which most wanted a hefty deposit to open an account, which we found ridiculous due to our circumstances, NO MONEY.In the end Lloyds TSB was the one. We have been with them for 7 years. After 6 months and my husband finding employment, we were offered current account with overdraft then a loan.
My advice is get in touch with experion, add note saying debt paid off, go to LLoyds tsb |

you should ask the solicitor who acted for the Claimant to send you a letter of Satisfaction for the payment of the CCJ.
send a copy to the court where the case is registered, together with the fee( details usually in letter)
the court will then advise registry trust ( who maintain the public records of CCJ's) that the judgment has been satisfied, they will in turn notify the credit reference agencies.you should also advise the original creditor to ensure that any Default notice registered is also noted
the CCJ will remain on file for 6 yrs but a bank will view a satisfied CCJ more kindly than an unpaid one
so good luck |

you should be ok to get a bank account.
Save up about £500 and walk in a say would you
accept this as a starting balance,

as for your credit record, you can wait out about 4-6 years,
Ya might be better moving house really to speed it up like |
