I am not an attorney I have recovered return checks for a living. Often bankers and bank tellers misinform people about post dated checks by stating they are illegal.
No they are not illegal. However, it is illegal to solicit a post dated check with the intent to file a suit for a bad check.
One way to look at it is all checks are a promise that funds will be in the account when presented. The bank is not required to hold post dated checks. You better have an up front understanding about exactly when the check will be deposited.

QUESTION: If a customer issues a post dated check and we accept the check through our cash letter from the FRB, what is the legal steps concerning this item?
ANSWER: The model version of the UCC places the risk of post dating on the customer.
At 4-401(c), it indicates: "A bank may charge against the account of a customer a check that is otherwise properly payable from the account, even though payment was made before the date of the check, unless the customer has given notice to the bank of the postdating describing the check with reasonable certainty..." (Compare this to the parallel provision in your state's law to see if there are any variations.)
In short, if you see that an on-us check is post dated, you can pay it or return it. It is the bank's option. If you keep it past midnight of the banking day following the banking day of presentment, you have made your decision - you paid the check and it is too late to send it back.

According to the FDCPA :§ 808. Unfair practices [15 USC 1692f](2) The acceptance by a debt collector from any person of a check or other payment instrument postdated by more than five days unless such person is notified in writing of the debt collector's intent to deposit such check or instrument not more than ten nor less than three business days prior to such deposit.
(4) Depositing or threatening to deposit any postdated check or other postdated payment instrument prior to the date on such check or instrument.
It is clear that a post dated check is fine if done correctly.Hope this helps! |

I have heard it is illegal, but it doesn't matter if the check is postdated or not because the thing that matters the most is your signature. A check can be cashed anytime if it is signed. |

its not that they are illegal, but there is no such thing as a post dated check. The date written on the check does not matter because as soon as it is signed the check is 'live' (legal tender). |
