BANK OF AMERICA SCREWED ME OVER!!! I need help!!?
Alright, here is my situation, I have a checking and credit card with them. I set up my credit card payment to come out on the 10th every month, for some reason it came out on the second, and they are telling me that it was not a bank error, and that It is my fault.

So since they took out the $100, that left me with 82, but I put about 100 on my card since last night (dinner and movie and stuff with girlfriend.)

So now I have FOUR transactions that happend when I was "overdrawn" and there is a $20 fee for each time you make a transaction when you have insufficent funds.

The only reason I have insuffiecent funds is cause they took out my credit card payment a week too early.

So now I am $119 over drawn, but I am supposed to have $60 in my checking.

Do you think I will win this dispute? I am okay with the 100 being out, but I don't think that I should be charged $80 in fee's because they screwed up and took the money out tooo early.

What are my chances of winning?

don't give up because I know from experience that they are a sh*tty bank. once you get this mess straighten out (or even before) get set up with a credit union it was the best decision i ever made.

switch banks....i and many others i know have been screwed over by bank of america. even if it is a bank error, they will find a way to make it your error! anything to make a buck!!! i now bank ONLY at wamu...their checking and savings are way better..highest interest return rate for savings...almost as high as a mutual fund.

you will never win against bank of america...they will always have an excuse/reasoning for their actions that you not be able to disprove!

When you signed up for the automatic payment, there would have been a form you would have signed stating exactly when your payment would be withdrawn. |FIND OUT EXACTLY WHAT YOU AGREED TO BEFORE DISPUTING

As long as you have the paperwork you signed agreeing to the funds being taken out on the 10th then you have a chance. But even if you dont Fight it. Sometimes if you get a nice customer service they will waive it this first time.

you need to go to the bank and sit with a customer service rep and explain situation. ask them again when the fee will be taken out and show them your statement. if you do not hav any documentation stating the date they told you originally then you may be charged. some banks will refund the charges on a one time only basis. any other problems arise, find a new bank

This is what you do if they won't remove the fees.
Whatever state you live in find the web site for the banking commission. File a formal complain in writing. There should be instructions on the site. They will do an investigation which will force the bank to answer to whatever they did.
They are governed by very strict laws & complaints are taken seriously.
I had reported a bank for fees & I got them back.

Your only chances of winning falls on if you have a copy of the paperwork stating the 10th as the date they were supposed to draft..... I would go into the bank and visit with them and try to work with them, if they will not work with you.... quite simply tell them you are going to switch banks and call the Better Business Bureau to file a complaint (make sure your paperwork says the 10th and not the 2nd).....

Regardless of the fact that they took the money out to early you should not have spent the money knowing you didn't have it to spend and then (after the fact) expect to be reimbursed on the thought that if you wouldn't have taken it I would be okay....

This is called spending over your means, regardless of thee reason. Once you noticed it was an error you need to go into the branch and show them your signed agreement of the money coming out on the 10th and ask them to resolve it but you cant spend money you don't have without owing someone.

Your chances aren't great, but are not bad. Clamly present your case to their customer service. If that doesn't work, ask to speak to a supervisor. If that doesn't work, ask fro the email address or the phone number of the CEO. Naturally, you won't deal with the CEO, but you will get your best shot at the top. One of his staff members will handle it. If you have documentation that supports your story, you have a very good chance.

If you have in writing that they are to take the money out on a certain day, then yes go talk to the back manager and ask them to return your overdraft fees, you should win.

I would go to a new bank.

My wife worked for BoA for a while and they are the worst. You are most likely screwed, because even if they have proof they were wrong, they will find away to make this your fault. You may get your fees beck if you happen to get a newbie in customer service, but do not count on it.

They screwed me over, too, with charges on the checking account. We considered filing a complaint but when I inquired, someone laughed in my face and told me the bank had more attorneys than the gov't did. Later it was a problem over the safe deposit box: We moved and didn't get the billing for the charge. So they broke into the box. You'd think we would have known better and cut all ties with the bank after that time. But there was one more thing: the B of A Visa dispute. We closed that account and I cut up the cards. After that, we had no more to do with B of A and that was 30 to 40 years ago.

Since severing all ties, we have had no banking problems. We bank at the credit union and savings and loan..

Stay away from B of A. They are customer unfriendly.

Nearly exact same thing happened to me. I ended up paying all the overdraft fee's etc. and then changed banks! I HATE B of A.

Good luck man, I had the same thing happen to me, but it was done is larger amounts. There's no winning with them, I tried for over 2 years, and that was even after I went to a new bank.

They even kept charging us for our "free banking w/ direct deposit" even though we got direct deposit each week. That's just two things out of a dozen; they really are horrible.

BOA is the most disgraceful excuse for a bank.

Sorry you had to be another BOA statistic!

Good chance. Do you have the paperwork that you filled out for the withdrawal. If so, fax them a copy or go to a branch.
