Baclaycard debt sold to debt Collection company?

I was owing Barclaycard about £3900 12 years ago. since woolwich PLC was purchased by Barclays ny details have now been passed to barclays. barclays has now sold my debt to a company called Red debt Collection company.

should enter into agreement with red to pay this debt.

your advice is need. please let me know

If you have not been making payments towards this debt or been contacted by anyone about this debt for more that six years, then it is dead and not recoverable by anybody.

I also second Reggie's advice. Don't ring them or write to them and certainly don't make any arrangements with them. The debt is dead if there has not been contact for over 6 years (this means you contacting them, not the odd rude letter!). Let it go now. They do often try this on but it will only cost them money.

im in australia and i have worked in credit collections. after six years the debt becomes statue barred. This means the debt needs to be written off and It is against the law for any credit collection company to demand payment off you whether it be by payment arrangement payment in full. Goodluck and i hope i have been of some help.

I would have to assume there is a Statue Of Limitations (SOL) on bill collections. Here in the US there is, but we have a bunch of companies that are called "bottom feeder" companies that purchase these old debts for pennies on the dollar, and will do anything, and everything to collect this debt.

I would also imagine you would have something similar to our Fair Debt Collection Practices Act (FDCPA)

If so, You should be able to fight against this collection agency, So I would do some research to see if there are similar laws where you live.

(UK) The Limitation Act means that if the creditor has not contacted you at all for 6 years, the debt is wiped. That does not mean you can move house and say you haven't been contacted, as the creditor can prove they wrote/rang you on previous addresses/numbers. It is NOT true that you have to ignore their letters and goes away, the Act is there to prevent people from being harrassed by old debt 10 years on where the creditor hasn't chased it. The fact that you know Barclaycard have passed it to Red Collection means you've received a letter/phone call(s), and thus the 6 year Limitation doesn't apply. Where the creditor is chasing this debt and sending letters, you are liable. If it had been a different circumstance - eg you suddenly receive a letter from a 7 yr old debt and you've (truthfully) never been chased, you could defend the liability in court. Unfortunately this doesn't apply here. You'll have to come clean (as they are aware where you live I assume) or else they can get a court order and get Attachment of Earnings (deductions from pay), Warrant of Execution (bailiffs), or bankruptcy etc. You should be able to come to an arrangement based on your capacity to pay.

no one has a clue how to deal with debt until the people go through it there selves. i was £30,000 in bebt frightened to answer the phone wondering weather i would come home and my house still be there.

1st hit the probroblem head on, work out all your income, even the creditors that you think have been forgott.

write to them do not ring. do not give them your telephone number. if a creditor rings you or comes to your door it is a form of harasment, and is illegale in england.

2nd you are protected by the consumer credit act.

3rd creditors want there money yesterday.

4th to get out of debt priorites. that means food bill areas in that order.

5th whilst dealing with creditors say you do not work you get half of what you realy get, they never check. due to data protection they can only go of your word.

6th they can not take anything on h.p like a car with outstanding finance on it. however the finance company can appliy for a compulsery purchas order throught the corts, if you can proove you need the car they can not take this off you.

7th all catalogues will accept £5.
8th debt under £5,000 will accept 10% of the outstanding balance as long as you entre an arragement to pay.

ccj stay on you credit file for 6 years and then they are wipped away however your credit never is the same.

if you have fallen ito arreas council tax you can start paying this years tax and come into a volentry arrangements with the bayliffs, the bayliffs will onley come round if you ignore there letters.

if you are unemployed you can declaire yourselfe bankcrupt, but i would never recomend this.

i ran up my debt by taking loans to pay of debt, and credit cards. i even cashed £3,000 of cheques from the bank.
i mooved and changed my name.

i got a letter from the bank threting to make me bancrupt. it was then i realised its time to wake up to my creditors and stop running.

i did a v.r volintory arrangement, some creditors accepted straite away. some refused and to thoughs i thretend to sue them for incured intrest and take them to cort .

after 12 months i was finacley better off my health was a lot better.

i finley got invited in to the bank were they offered me a concilidation loan as i had kept to my payments.

i paid all my creditors and areeas off still had £500 for my self ., and instead of paying £900 a month back to seperate creditors i payed £115.00 for 14 years i was able to concentrate more got promotion and now earning loads.

this is a true story you do not know untill you done it . i did it and i got out of it .

yes, if Red have bought your debt you need to speak to them about making repayments, not Barclays etc

hi there i would reccomend that you come to some kind of agreement just make an offer of what you can afford and pay them every month. because if you dont then they will get the money from you one way or another atleast then its not on your mind you can stop worrying about it.
