I had a bank account and got stung for overdraft charges.
To cut a long story short, it has now been transferred over to a balliff company. Now because of all this unfair buisness with ludicrus charges that has been in the news and papers we read, im hitting back at this certain Bank to see if im entitled to money back.
My question to you is do the balliffs have to hold on until this matter is resolved with myself and the bank, and if not, im unable to the pay the full balance so will the balliffs except a minimum repayyment monthly?

Hi your best bet would be to go onto the website listed above to reclaim the charges etc.
BUT
If you let them into your home they will take an inventory of the goods they think will fetch anything.
If you cant pay or default again they can gain access any way they choose to take the goods!
If they have to break the door down to take the goods then they are legally allowed to! Hence the reason behind
NEVER LETTING THEM INTO YOUR HOME!
THEY CAN ALSO CLIMB IN AN OPEN WINDOW TO TAKE AN INVENTORY OF YOUR GOODS SO BE CAREFULL AND TRY TO KEEP YOUR WINDOWS AND DOORS SECURE(THEY HAVE BEEN KNOWN TO USE A LADDER AND CLIMB THROUGH UPSTAIRS WINDOWS TO GAIN ACCESS TO HOMES)
This is not just your case this is to anyone that may have dealings with these people.
Yes they are just doing their jobs but im afraid they are not exactly caring and understanding.
If you have ended up in a situation for balliffs to be knocking at the door then your probably in a bit of a hole and the last thing you need is for someone coming in and taking anything you have left that is of any value!
If the Balliffs do not get anywhere with your case it will be handed either back to the creditors or another collection agency.
There are also situations where they will take LESS than the amount due just as a closure to the case so always ask if there is a reduced amount they will take to close the account. This does not apply to the bank charges one though as the bank will have to refund them and any costs incurred with them (balliffs fees etc)
SO DONT OFFER TO PAY THE UNLAWFULL CHARGES BACK!

A bailiff will send you all kinds of letters to frighten you into paying up!, this debt is a very low priority debt, as it is an unsecured debt. a bailiff is not allowed entry to your property without a court order that allows them to do that, o.k?.
All they are allowed to do at this stage is send someone to the door to ask you for money, they have no other action, if this happens just say you cant afford to pay as you are in dispute with the bank concerned. I would seriously take some advice on the matter of charges, as you are aware a lot of people are suing the banks at the moment for ridiculous charges that are over the top.
Send a letter to the bank and charge them( this is what they do to you) charge them the same and invoice them.
stop worrying, this is standard practice for the banks with bully boy tactics.
dont pay and make sure you take advice at CAB.

The bailiffs don't have to put the case on hold while you are contesting the charges with the bank. Generally they will only suspend action on cases if the company or authority they are acting on behalf of tell them to do so. In effect, this would mean that the bank would have to tell them to put the case on hold while they look into your case - if the bank won't do this, the bailiffs will continue to take action.
If you are unable to pay the balance in one lump sum, most bailiff companies will make a payment arrangement, but they will almost certainly only make such an arrangement after having taken an inventory of your goods. If memory serves, this is known as 'walking possession'. If you subsequently defaulted on the arrangement, the bailiffs would be entitled to gain access to your home to recover what would then be THEIR goods.
My advice would be to contact your bank in the first instance and request them to put a hold on the case until your dispute regarding the charges has been dealt with. If they refuse to do this, you will either have to deal with the bailiffs, as outlined above, or, do what another answerer suggested, and ignore them.
If they cannot gain access to your property in the first instance they will eventually return the case to the bank, who will then have to decide what further action (if any) to take. |

do not allow them entrance to your property at all,no matter what they try to blag you with.lock your doors and windows as if any are unlocked or open they can enter by that way without your permission.but they cannot take anything from you unless they have a warrant from the court. Remember the bailiffs are only in it for the money,even if they have got no feelings or heart. |

I think that you can no longer deal with your Bank once they've called the bailiffs in. Why don't you go to the website www.thedebtpeople.co.uk. for advice. I wish you good luck because I don't like the 'strong arm' tactics employed in today's world. It's nothing short of bullying when people need help the most. When the deputy prime minister, Mr John Prescott, didn't pay his Council Tax the bailiffs weren't sent to his property to seize his goods. Have you noticed too that bailiffs look like club bouncers? Hope you get through your problems. |

You should be able to arrange with the bailiffs a weekly or monthly payment but they will not wait because effectively they have bought the debt from the bank and you now owe them, not the bank. (At least this is usually the case). The quicker you speak to the bailiffs and pay the first instalment the better. If you ignore them, each time they have to come round the bill mounts up and they will eventually take your goods to pay the debt. All the best with your attempt to get the bank charges refunded. |

Your account will not have been passed to a bailif company but to a debt collection agency. The debt collection agency will try all means possible to contact you prior to bailif coming round and they have to give you written warning that bailif action will be taken. They will normally telephone, then write and some will even send a personal advisor round to you to discuss payments. It needs to go to court before bailifs can attend and the debt company will try and agree payments with you for ages before taking steps to take you to court.
my advice to you would be to telephone the debt collection agency and explain that you are currently questionning the debt and request that they suspend all action on your account. they will probably verify this with the bank.
If the matter is not resolved in your favour (which i hope it is of course!) then you need to compile and thorough this of your income and expenditure showing how much you can afford to pay each month or week to them (make sure you work the figures in a way that shows you can afford what you want to pay them). You then need to send this to them with an offer of payment - they will 99% of the time accept the payment no matter how small - if it went to court it is probably all they would get anyway.
Hope this helps or if you need any more advice you can always contact National debtline who are a non-profit making organisation there to assist people who are having difficulties financially - they know the law inside and out about what companies can and can't do or alternatively book an appointment with the CAB and they will help.

you can claim back your bank charges , visit www.comsumeractiongroup.co.uk . they will have all the letters you can send to the balliffs, and the bank itself. this will delay any action, once the bank charges have been taken off you then arrange how much you pay back a month |

It's only the bank concerned that can call the bailiffs off.
Depending on how much the debt is they MAY accept a weekly/monthly amount.
Get yourself to the C.A.B. , they're experts in these matters, and their advice is free. |
