Hello everyone. Unfortunately, I had to file for Chapt. 7 BK recently and had a question regarding bank accounts. I know that I am not allowed to have money in my bank account before I file for BK because the Trustee will seize all my funds. However, does anyone know when I'm allowed to have money in my bank account? After I file for BK, after the meeting of the creditors, later? For anyone who has experience, I'd appreciate input. Thanks |

Who ever told you you were not allowed to have money in your bank account is mis-informing you.
Any bank accounts you have needs to get included in your assets listing. You are allowed specific exemptions(based on your state). If you have more debts than assets you won't have to give up any to pay back the creditors in most cases. Such as if you have a secured item, like a car, and decide to not pay on it anymore you would have to turn that in.
Now, on the other side of this, if the trustee thinks you are "hiding" money they will go into your records deeply. At that point they could actually throw out your bankruptcy and in extreme cases file charges of fraud against you, because you are hiding money you actually had.
Now if you do have a huge amount of money, that the trustee would determine could pay off your debts. Then perhaps bankruptcy is not the best thing for you to do. |

OC is correct. And as a matter of fact, you need to do everything you can to KEEP your account open, and to try and KEEP a couple of credit cards. Pay the cards off and reaffirm them so they won't close after the BK. Otherwise you will have a terrible time getting your credit started again. |

I filed for bankrupt 7mos ago. But I never heard of you not being able to have a bank account because of it. I had mine when I filed, and they did not touch it. Bankruptcy can protect you from alot of things including your taxes from being taken from you. |
