yes, but normally they will just hand it over to a bill collections agency that will get a judgment against you. If your about to file bankruptcy though, don't worry about it. they're not going to throw you into debtors prison or anything. they'll just call a lot and send letters. Once you are in bankruptcy, it'll be sorted out. |

Yes, you can be sued prior to filing for bankruptcy.
The question is: How many other debts do you have? It's foolish to file bankruptcy for just one credit card.

They can and do. But interestingly, they don't sue you until months and months of default interest have been racked up. That's so that they can then sell their defaulted loan portfolio to others who will mercilessly chase their prey until they become indentured servants paying wage garnishments or until they are driven into bankruptcy. Credit card issues are basically high-class loan sharks and consumers really should not forget this.
If they obtain a judgment, credit card collectors won't usually try to take your things - although when you buy a big ticket item like a TV or even a computer with a store credit card, you will be surprised to find that you gave the stor a security interest in the big item you purcuased -- the credit card company will try to garnish your wages.

They can. The only way that they can do this is show up at your Bankruptcy hearing and contest your debt. The judge can decide to dismiss the debt or tell you that you have to pay ii off one way or another. Generally is is cheaper for them to just charge off the debt then show up at your hearing, so most credit cards are dropped. They can not come after you once the bankruptcy is final if you list them as a creditor. If you did not list them as a creditor, then they can try and collect from you any way they wish. Bankruptcy only protects you from the creditors listed at the time of filing and final judgment |

If you have already "Filed" for bankruptcy, they can NOT sue you. Bankruptcy stops all actions against you. They can sue you "Before" you actually file though. |

Yes you can be sued before you file a bankruptcy. The date the Bankruptcy papers are filed at the court, all legal action against you must stop.
Depending on your situation you will be allowed to file Chapter 7 (fresh start) or Chapter 13(payment plan).
Consult a competent Bankruptcy attorney, they will tell you if you qualify under Chapter 7.

listen go to a law er like i did is free,people if u don't know don't ans er, the credit cards can not not say it again can not do anything they can not touch your properties, they can not touch your banks accounts is against the law u want to pay, pay is the right thing to do, u don't want to pay ignore simple as that, u don't have 2 go bankruptcy.. |
