Cab husband be responsible for debt?
Can my husband be held responsible in court for my credit card debt if he had no knowledge of the debt?
I am being taken to court for a credit card debt
Do they try to bring into court the spouse,or try to put a lien on the property

If it's in your name only, no he can't be held responsible for it. Lien on the property; absolutly if you have a debit and can't pay it, they can get a judgement and have a lien attached to your property. Joint property attachment differes a lot by states.

Generally, yes. It depends on what state you live in though. Many states are community property states, which means that a married couple are responsible and share in all earnings and debt. If you were to break up with him, everything you earned or became liable for would be split evenly. You are being sued by your credit card company? I would look to hire a lawyer (please tell me you've hired a lawyer, they have lawyers, sure of that) to settle and look for payment. you also might want to look into debt consolidation which often has a lower interest rate, but beware of scams (again, have a lawyer).

Good luck, hopefully you won't lose your property, but it is going to be tricky.

if that debt was taken on after you got married, then yes, but only if you live in a community property state. Your debts are his debts and vice versa. Otherwise, the answer is no.

I agree with most of these answers, especially Jake's, but would add one more fact. Many states have what's called "Family Expense Statutes," which means that, regardless of whether or not it is a community property state, if the debts were incurred for essential family items (e.g., food, housing, medical care, etc.), then both spouses (would that properly be "spice?") are jointly and severally responsible for the debt, which means each is 100% responsible..

If the property is deeded in both of your names, yes.

Yes, he can be held partially responsible for your debt - it's part of that whole "for better or worse" thing.
If your husband has no idea that you're in debt or being dragged into court for it, it's time to stop lying/hiding and tell him the truth.

My god, suck it up and you pay for it. Why should your husband be responsible for your debt? This makes me sick.
