Can Bailiffs take my stuff??
Hey i live in uk, my parent has the Bailiffs coming round 2moro to collect stuff for a council tax debt, i own the most expensive things in the house as i have saved birthday and Christmas money to get them, are they aloud to take my stuff as the debt is not mine. also this bill was paid they just say it wasn't we have proven this as they have see a bank statement but say it takes 4 weeks for it to clear we only paid it a week ago when the asked for it so !!!!dont say pay up!!!!!

no they wont take anything of yours or your parent they will just take a note of the things in the house and as they have paid there wont be a problem they just try to scare you i know its sh@@ but that's what they do low life scum i know iv been there don't worry to much about it mate try and have a good day Bangkok!!

I would say yes they can, they are ruthless people. Store your stuff with a neighbour temporarily. i wouldn't pretend not to be in either, they'll bring the police round!!!! Good luck, hope you manage to keep your stuff.

Louis, the bailiffs can only take your stuff if they have a walk-in possession order to do so.

Did they come to your house in the past, and make a note of things they could come back and take if the debt wasn't paid (this is called a walk-in possession order). If yes, then there's not much you can do - they can break-in if necessary, and if you have gotten rid of the stuff, then you have broken the law.

If they don't have an order then NO, they cannot take your stuff. Neither can they break-in to your home (although they can climb through an open window etc).

If its your parent's house, I doubt they can take "you're stuff" - if you bought it with your own money (useful to have receipts).

You're not responsible for anyone else's debts - including your parents. Plus it would be a national news story if baliffs took the possessions of someone under 18 - especially coming up to Christmas.

However Baliffs can be ruthless, and each time they don't get paid, they often whack up what you owe (less so in Council Tax cases).

Get your parents to do themselves a favour. Sort out their finances. Council tax... they must be employed else they would only have to pay 20% of the full rate. It can't be too hard to come up with a sensible budget including money for council tax. Cut back on the cigs and booze.

Plus if you've paid it - show them a recipt - or contact the council and explain situation - in person if necessary.

If you can prove that the items are yours then they can not.

You will need receipts and to show the money came from your bank account.

Also a bailiff can not gain entry to your home without the police attending, so dont let them in.

Again, if you can prove by bank stmnts that the bill is paid then they can not take your goods.

any problems call the police whilst they are there, the police dont like them either!

Once the bailiff has entered your property once with your permission, they are legally entitled to return to your house at any time and enter at their own will. They can then even force entry at any time of day or night. You may find this unethical, but unfortunately this is the law.

Hiding your possessions when the bailiff arrives tomorrow then bringing them back to the house will do no good. You will have to leave them where you are stashing them until it dies down. Anything a bailiff touches in your house or leaves a badge, mark or sticker on is fair game to them. If it is not your property you will have to debate this later on.

You can legally refuse the bailiff access to your property. If they are abusive you can call the police. They must also produce a bailiff certificate or identification. But watch it, they can be sneaky to get it. Dont let them "just use your phone" or "just use the toilet". As soon as you let them in peacefully like this, they can ear mark your things, and as I said before, return at any time.

On top of your initial debt, the bailiff will also make a standard charge for attending your house. I believe its around £20 to £30 each time. They are not allowed to charge ridiculous amounts for this. They will also charge you a daily fee for storage of items that they have recovered out of your house. This goes along side of your original debt.

If there is any abuse or threats, CALL THE POLICE. The bailiff could have his certificate revoked for this kind of practise.

How odd.

You have proof that the debt has been paid so why are the bailiffs still coming.

I have never heard of payemnts taking 4 weeeks to clear unless it is a foreign chequ negatiation which is unlikely in this situation.

If you can prove that you bought the item then know they can not take it.

But you say the debt has beeen paid so why would they want to take anything. ??????????

First of all ask your parents to contact the council and tell them that you have paid .The bailiffs take their instruction from the council, if someone tells them that the matter is settled in full, they have to accept it. Secondly, they can not touch your stuff,but they can ask for the proof that the goods belong to you. Common sense dictate that you sort out the problrm with the one who issued the warrant in the first palce ie Council.
