Unless you have it in writing from her that she owes you any amount she charges on that card, it will affect you. The fact is that this card is your name. You essentially handed over to someone else your financial future. The task now is to mitigate the damages.
You have got to find a way to get in contact with this person. Legally she is not obligated to pay you. Hopefully, she does not know that. Tell her that you want the balance for this credit card debt. If she gives it to you, great. If not, on to step two.
Send her a formal letter CRRR stating that if the debt is not recieved by a certain date, you will be filing a lawsuit and she will be responsible not only for the entire amount of the debt, but for any legal fees that you incur in the process. Granted, this is a bluff, but hopefully its a bluff that pans out and gets you your money.
Even if she does pay, your credit is going to take a hit because of the late payments. Hopefully the account has not already been charged off to a collection agency. If it has, post here again and we will help you with the necessary steps to take care of that. Collection agencies are a whole different entity than the origianl credit card companies. Hopefully there will only be a 30 day late marked on your credit report. You need to get copies of your credit reports from all three credit bureus to see just what is going on with your credit. Sometimes a company will respond to a "goodwill letter" explaining why the late payment was not your fault and will remove the late notation from your credit report. Either way, its worth a shot.
No matter what happens, you need to pay SOMETHING to the credit card company as soon as possible to prevent the account from going into collections while you try to get your money from this girl. Anytime someone cannot get credit on their own that is a red flag. NEVER co sign for someone with bad credit or allow them to get credit in your name. It will almost always come back to bite you.

unfortunately, it has already affected you as a nonpaid deliquency. your first move should be to contact the creditor. see how much that you owe. if it's a large amount, try to work out a settlement with them. the creditor doesn't care that you opened the card for her unless she is on the card too (sounds like she is not..authorized user is not the same as being "on the account"). either way, you are legally responsible for the whole debt.
the other part of the problem is that there is no written contract of the agreement between you and your friend about this card. therefore, there is no legal obligation for her to pay back anything on said card. speak to an attorney about this (and again this depends on the amount), but i'm betting that he/she will tell you the same. this will be hard to prove in court. sounds like you have learned a valuable, yet hopefully not too expensive lesson. |

Did you have a written and signed agreement with her that states that she is responsible for that card? If you can't prove that she was supposed to pay it off, I doubt a court would be able to do anything for you. Since the card was in your name, that makes you legally responsible for it. The only thing I can think of is, maybe you could claim she stole your identity to open the card?
The smartest thing you can do is suck it up, pay off the card, and learn from the experience. You should NEVER lend your credit to anyone, and you should only co-sign for someone if you are 100% sure they will pay off the debt. |

If you opened it in your name (by the way is a largely stupid thing to do) it's in essence your card and ultimately your responsiblity.
I understand you wanted to help this person but you cannot sue without having some written proof that she was to repay the debt.

First if she failed to pay on the account it has already effected your credit report. The company that contact you was probably a collection agency and they have put a collection account on your credit report.
You have two things to deal with.
The first is with the actual account. You need to send the collection agency a settlement offer by Certified Mail with a Return Receipt. In that letter you need to state the total amount you are going to pay as well as a requirement that they remove the collection account once paid. Only when you get an agreement from them in writing do you send them any money.
The second is with your ex-manager. You need to take her to Court. You can go to small claims if the amount is under a few thousand dollars. In court you can sue her for the amount you had to pay. Your only problem would be proving that you had an agreement that she would pay back any charges she made. The more proof you have to this(such as a written agreement) the better your case. |
