If the credit card is from the same bank as your checking account, then I would expect that there may be some fine print in your credit card agreement that may allow this to occur. However, if the credit card is serviced from an outside source, then maybe not. If not, they need to get a judgment against you in order to attach your account.

An anonymous call to the credit card company should clear this up.

In the future, you might want to have a card not associated with your bank.

Yes they can and without your consent ~ this is usually the last option before collections. Usually they will send you a letter stating what they have done or intend to do

What sense would it make to be able to get money from a bank that you owe money to

Depends, if it's in the terms and conditions that they can, then they can.

In your case I would think that if they could have done that, they would have before they sent the account to collections.

To be safe, you might close that account and open another one at a different bank.

Usually not. But it can and does happen. Normally they will have to take you to court and get a judgement against you. Then they can apply for garnishment of wages and bank account seizure. This is true even if your checking and CC are with different companies. If they are the same company I don't know but you have to realize most consumer banks don't offer there own credit cards (true listen up). I think the only one that does is Bank of America since they bought out MBNA but they are different divisions that probably operate like different companies. Now most banks say they offer their "own" cc it is through a different credit company such as providian which is popular with consumer banks. I used to beleive the same think with my wamu checking and wamu cc but the wamu cc's are through providian. Look at the fine print I really think they have to have a judegment. The only other entity that can take money from you without a judegment and payment order is the government and it has to be debt you owe to them. Good luck.

Did you have their permission to not pay? Take a look at your disclosures. I'm certain to say that there is a clause in there that states any account with that institution may be off-set to pay any loans, lines of credit or fees due that institution. If you cause a loss to a financial institution, most will disallow any further services until the loss is reimbursed. However, this is not the case with bankruptcies. Are you not paying the card because of a dispute? If this is the case, you must still make your monthly minimum payment, but file a written dispute and the charges in questions may be reversed until the matter is fully investigated.
