Can a Collection Agency actually remove ones car in order to settle a debt?

Yes, if the collection company has been granted papers by the courts authorising them to do that.

Life is much easier if you avoid buying things you can't afford, then you don't have the need to ask questions like this.

Live within your means, you may have less stuff, but lots of stuff doesn't really ensure a happy life.

yes , afraid so.. have you ever watched a programme called 'bailiffs'...if you're in the uk.

gill c
yes they can, my brother would confirm this, the very same thing happened to him. They went to his place of work, lifted the car and drove off. It is perfectly legal, just check your loan paper work. They sold the car for much less than the amount of the outstanding debt and he still had to pay off the deficit.
Warning, don't leave your car parked anywhere.

alatoruk
depends on the debt, but they can take anything belonging to you, if it is yours then yes they can take it

Big Bad Boris Mayor of London
Yes

leonardhomes@sbcglobal.net
Isn't that funny how that works. If you don't make the payments on the car they can come and get it. What did you think would happen? They would say OH hell he was a nice person just let him keep it.

stephbrown2005
Yes at my job, we call it open end lending. Pretty much if you have a credit card with us and a car loan, you can't just stop paying the visa because you have to pay the car loan. If you default on any loan with us, we can take your ride...

Only if they are collecting for Council tax or car fines. All the other agencies that try to recover debts dont have the power unless they go through the court first!

confucious says
yes they can and they dont have to have a court order you see it on the tv almost every day they dont actually take the car straight away they clamp it first and give you a chance to pay. and if you dont pay they take it away

Bhavesh
Yes they can, provided they have legally signed documents from the loan holder and they completed all legal proceeding before removing the car.

Depends on if the car is paid off and if you used it as collateral in getting credit.

they need a warrent and only the police or beliff can do it

nosdda
If the car was bought on HP then it can' be taken without a Court order. If it was purchased on a Credit Agreement, then they can take the car. This is because on a credit Agreement the car is not yours until the final payment is made. Until then, It is still the property of the lender.

ali
No they cannot if you need the car for work then they cannot by law remove your car and take it.

That is the law. If they try, call the police, But it does depend on the fine.

If it is a county court proceedings or crown court then they can take the car.

Andrew C
no, they can threaten but it's bluff. only a bailliff or policeman, and they have to have a warrant

tmin
No, the only one that can and does take a car is the fiance company when they repo the vehicle other than that it's auto theft. collection agencies can only petition for payment, not even the courts can force you to give up your car for a repayment of moneys borrowed.
In the US. it's called your 5th amendment right.
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself,

nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

I hope that helps. take care and Keep the Faith
