clfton1 | Can a collection agency garnish your salary or threaten jail for an unpaid bank credit card debt? |
|

In order to garnish your salary they have to get a court order. You cannot go to jail for debt anymore, but if you knowingly wrote bad checks against the account but that would still have nothing to do with a collection agency They also cannot harass you at work as long as you provide a valid phone number for contact.
What they can do is adversely affect your credit by reporting the bad debt. You will pay higher interest rates for car loans and mortgages.
The worst thing you can do, as with any debt, is not to communicate with the creditor.
Here is a link to a helpful guide. http://www.wdfi.org/ymm/brochures/credit/debt_collection.htm
Best of Luck! |

No, you cannot go to jail for debts. There is no debtors prison! However, they can garnish your salary if they get a judgment. |

I work in the Data department of a collection agency and I know that they can garnish your wages by taking you to court. They will make you pay court cost and attorny fees, etc and also get to garnish your wages. And the thing about jail time is false unless you lived back in the Regency era of England there was a Debtor's prison. Anyhow, offer to pay monthly for example my company only accepts the min. of $25. a month but ask your company that you owe the bill to. |

No, But they can garnish your wages from your payroll if you don't pay them. |

a collection agency can sue you and get a judgement to garnish your wages but they certainly can not put you in jail. |

Yes they can garnish your check but I do not believe they can put you in jail. Work out a plan with the card company and pay them their money. |

Yes, your salary can be garnish your wages with a court order. There are guidelines as the percentage of $$ that they can collect from each payroll check. Credit cards are low on the list of collections. The only leverage that a collection agency has is to put pressure on you to pay up. Child support, back taxes, lien come before credit cards collections.
In the United States no private company can demand that you go to jail for none payment of a credit card.
Below are links to Stanford University and some of the basic questions about garnishments. |

I think in the contract you signed wayyy back when, you gave them permission to get their money back in whatever method they care to use. Sorry. |

You cannot go to jail from not paying your debt. They can in some circumstances garnish your wages, but that is only after they get a judgment from a court. It is also against the law for any collection agency to threaten to jail you. |

I used to work in Human Resources, and I saw garnishments come in about every week. Not only will you have to pay the debt, but you will also have to pay the court cost. They can garnish up to 50% of your net pay. My advise is to pay the minimum, and if it goes into collections, then offer them 10 dollars a month, Hey, that's a lot better than getting garnished. |

A collection agency can ONLY garnish 25% of your salary. You'd need to contact an attorney if you've been threatened, by a collection agency, to send you to jail. |

They can put a judgment against you and it's up to the court to set a garnishee |
