Yes, they can do it by publishing a legal announcement in a newspaper before the statute of limitations runs out. If she does not respond the court will issue a judgment against her. Then the plaintiff will have 20 years in which to collect with interest. So someday your daughter may find that a huge judgment against her exists that a court will force her to pay by attaching her bank account or garnishing her wages.
People who borrow money and refuse to repay it are unethical and deserve to be faced with huge penalties. Your daughter's dishonest behavior amounts to outright stealing. |

They will get a judgement for 1000.00 if she works they will garnish her wages, even if she doesn't tell them where she works they will get it when she files taxes, if she owns a car or home or land in her name they can put a lien on it. But if you just dont pay and she has nothing there's not much to do but keep aggervating you. Do the pymt thing like i suggested, it'll work. and stop the annoyance. good luck. i know how you feel, my husband put me in this mess with a credit card. |

That first answer is very misleading. A collections agency is very, very good at skip tracing. And even though you don't give them her address, eventually, they'll find her and that $1,000 will be accumulating interest and fees the whole time. They can and will file suit and eventually, they'll find her and serve the papers and she may wind up with a garnishment. It would be so much wiser for her to contact them and set up some kind of payment plan. This way her credit will be down the tubes forever but if she pays it off, she will have a chance again at regaining a decent credit rating. |

Notice is a necessary element. If you deliberately avoid service there are other ways to satisfy the notice requirement though for 1k "hiding" may be enough to scare the CC company off. |

I have to disagree. They can sue you for under a thosand dollars and it would only cost them about 60 dollars to do it in a small claims court. However when taking someone to small claims court it is up to the Plaintiff to serve the defendant with the court papers. So chances are they are not going to have people working in the collection agency, that are going to spend the time and effort to track your daughter down for a thosand dollars. The annoying phone calls wont stop though. My advice is to change your phone number, and tell your daughter to cross her fingers if she is ever trying to get a bank loan later on. |
