Yes they can. When you signed up for the credit card you agreed to pay them at least the minimum payment every month on time.

They could, since you are breaking the contract, but they are very unlikely to, since it would cost them more than they would gain. What they will do is punish you by giving you a bad credit report. They might also raise your interest rate, and charge you late charges.

Yes. When you sign the application, you agree to all terms and agree to make the minimum payment due each month. You are in breach of contract, and they can take legal action. You should contact the company, explain your situation, and see if they will lower your monthly payment to something you can afford. During that period, however, you probably won't be allowed to incur any new charges.

As a finance professional, I suggest you pay off your credit cards in full and put the balance on a line of credit. That way you are only paying 5% interest instead of 18.9%.
Depending on the size of your credit card debt, you could save hundreds of dollars a month.

Call the credit card company and tell them you cannnot pay the minimum. They might freeze or take away the card but they will negotiate a repayment plan you can handle. I did this for my father. Typically they will offer a 9.9% interest rate with as long as a 5 year repayment. I would tell them that you cannot handle that payment and might default. They will come back with a 0% 5 year plan as a 2nd offer. Take that offer.

If you do not contact them then interest will continue to accumulate at an astronomical rate. Get this handled on the phone immediately

yes, the minimum payment is just that: the least amount you can pay. this would be the same as not paying, since you did not meet the minimum amount allowed

Yes..... but unless it is a large amount that you owe.... they likely wouldn't bother themselves.

They would likely sell your account to a third party and have them deal with you.

If you don't make the minimum payment, they add on an additional finance charge....

also , if all you make is the minimum payment , you will never get the charge card paid off....

It is an urban legend that a creditor can't do anything as long as you make some kind of small payment. If you are not making at least the minimum payment, you are in default of your agreement. The credit card company can sue. They would win a judgment and then attach your bank account, garnish your wages, and lien your property.

shows up on your credit as a slo pay...does bad damage...they may be able to garnish wadges...but usually its the irs that does that...

The credit card company will not take you to court if you can't make the minimum payment. Paying less than the minimum will not achieve anything, so it does not matter whether you do it or not.

What will happen is that your account will become delinquent after the first time you don't make the minimum payment and your credit history will be damaged. If you miss your minimum payment for a second and a third time, your credit will become progressively worse but the bigger damage will be done when you are 3 months late on your payments. Shortly after that the account will be charged-off (which means that the bank thinks it is uncollectible) and sent to a collection agency. Now your account will be noted as a collection account and your credit score will drop substantially. The collection agency will still not sue you but they will try to settle the account, usually they will accept 80% - 90% of the total as a settlement. If you don't settle, the bank will recall the account in another 2-3 months, place it in a pool with other charged-off accounts and sell them to a debt buyer. If anyone will ever sue you, it will be this debt buyer. Even they will first try to settle it, and if they can't, they will only sue you if they find an asset to attach, like a salary or property. Otherwise, they will not spend the time and money to take you to court. That's how it goes.

I wouldnt think that they can much other than wait for you to pay it off! I have paid off a medical bill before that way. I just paid what i could afford monthy when the payment was due. I beleive that so long as you make some sort of payment they can not send it to collections. I would hope that you are not charging MORE on the card though ,then they might get mad! Not sure though!
