If your bank account is the same place the credit card is issued, then the answer is YES!!!!! I was a banker for BofA and it's in the depost agreements and disclosures.
If not, and you pre-authorized it, they can get away with it. Otherwise, no, you have to have authorized someone to go into your accounts and pull any money. If this has happened you can call your bank and file a dispute.

No they can't, unless you authorize it. If you don't, then it is fraud. Just because they have your information, that doesn't give them the right to use it. Unless you say it is ok, or if you've sent up an automatic payment for each month until further notice.
On a side note, get back into current and pay it off. Then you wont have to worry about things like this.
