Before they can place a lien, they have to sue in court and win. If the debt is owed, settle with the original co, not the agency. If you have no knowledge of the debt, play their game and call them every 20 minutes stating you're waiting for a call back. |

Not in Texas, provided you applied for a Homestead Exemption. Texas had a gut-full of the Republican Carpetbaggers after the Civil War and passed some special laws to shield from debt collectors. Us and Florida (there's a reason WHY OJ lives in Florida, not CA). Call your County Tax Assessor/Collector. Just tell them you want the Homestead Exemption Claim Form.
But, it was Dubya, in his first year as Prez, that herded through the Bankruptcy Revision Laws that puts a cap on this Homestead Exemption. I don't know the top figure, but most Texans are well under that cap.
Also, if you go into Bankruptcy there isn't hardly any way to just drop all the debt and walk away. You have to pay $100 or so a month for a certain time. That is when folks discover they can't keep up the payments on the mortgage.
If there ever was a bigger ... of ... than Dubya, I don't know about it. |

no all the can do is get a judgement against you and garish your wages for the outstanding debt owed they can not place a lien against your house also they also say they will put you in jail but last time i checked i see no debtors prisons in the united states |

First of all, contrary to what someone posted above, you CAN get rid of all of your debt. Chapter Seven. I filed it so I know for a fact you don't have to pay it off, that's only Chapter Thirteen that requires you to pay some back monthly.
Secondly, they can't take your house unless it's your house you haven't paid on. If it's some other debt what they can do is come into your house and take things to hold sheriff's sale. But here's the issue with that, since you are married the items are considered split and there's no proof who they belong to so as long as things like your car have both of your names on it they cannot take it. I had this all explained to me when I saw my lawyer.
The only thing going on with the new bankruptcy law is that you have to go to counseling by a credit counselor and then take a class before your lawyer can actually start the process for your bankruptcy. |

NO Unsecure debt....Need to advise the creditor to stop call at work, this is a violation of the FDCPA. Look up FDCPA and find out what your rights are. You might be surprise. |
