Can a store charge my credit card without my signature if they claim they undercharged me?
I bought a necklace for $56 from a store. Coincidentally I ended up losing my credit card that day so I called to cancel. The store called me to tell me that they made a mistake and I need to give them $100 more for the necklace. The next day the managed to charge my credit card (the one I had called to cancel) $156 and refunded the original $56. I never agreed to this increase, and the credit card company is resistant to do anything. What should I do?

The only problem you really run into is if the Credit Card company decides to fight you on it, and you cannot prove that you cancelled the card. But, once you call and notify the Credit Card company that the card was stolen or otherwise compromised, you are legally no longer liable for any charges made on it afterwords. Call the Credit Card company and tell them that a charge was made on a cancelled card and that you are disputing that charge, then do it again in writing by mail. Also, call the store and tell them that they made a charge to a stolen card, you did not authorize a $156 charge and ask them to remove the charge. As far as I know, once the transaction is complete, unless there is a written agreement to the contrary, they cannot come back and charge your card again without your permission. If they sold you the necklace and accepted the original $56 charge as payment, then the transaction is over as far as the store is concerned. If you still have your receipt for the original purchase, you can prove your position and I don’t see that there is much the store can do.

its a fraudulent charge. Make sure you have your original recipes and file fraud with the credit card co.

credit card billing. Simply tell him "This is unacceptable" If he refuses to do anything. Tell him " thank you for your time. I will take this to the Better Business Bureau, and never shop here again, nor will my friends and family" YOur other option is to return the necklace for full credit on your card, with a personel note to the manager informing him you , your family and friends will never shop there again. Your third option is to take the store to small claims court...first notifying the Manager what you are about to do. I have had store's reduce price just because it is advertised cheaper elsewhere...Good will is usually very important to merchants..the manager may not even be aware of what was done. It may just be department manager trying to cover their (you know what) for an error they made. Keep up the good fight!!

price, then in most states the store has to honor that price. They can not just charge your account for anything without your permission.

But, the "right" thing to do is to take the necklace back and get the charge reversed, if you knew that the price charged was incorrect.

However, since you "coincidentally" lost your card and closed the account, the BS detector in me is going off, and I get the feeling the story is not the same as reality.

your credit card company and dispute the charges. A retial vendor or anyone for that fact, CANNOT just decide that you were "under charged" and use your credt card info to get the money. I really REAM their ^&%$#! for this. also contact your LOCAL BBB. If it were me, I would want other customners to know that THEIR credit card information is NOT secure. I wonder if you had beeen "OVERCHARGED" if this vendor would have given you a credit??? Despute it...Do not pay....I would love to know who you bought the necklace from, so I make sure NEVER to purchase anything from them. What nerve!

1) I would send the credit card company a copy of the receipt and tell them this represents the contract between me and the store and that they cannot change that contract after the fact.
If that doesn't work,
2) Take the store to small claims court.

What was the displayed selling price of the item you bought - $56 or $156? If it was $156 and the clerk made a mistake and entered $56, my moral compass would say to me that the mistake had been corrected and I should feel relieved about my guilt being lifted for not pointing out the mistake at the time of the transaction.

If $56 was the price displayed and they agreed to sell it to you at that price, then it’s a different story. You entered into a contract to buy at the displayed price and they agreed to sell it at that price. If the store later discovered that it was the wrong price, it’s too late. They are obliged to sell it at the displayed price or withdraw the item for sale. That is my recollection of the trading law in B.C. (assuming this purchase was a local one) having lived and worked in retail there for many years.

If this was not case, then what is to stop shops everywhere from raising the prices on items hours, days or weeks later on any or all of your purchases? A line has to be drawn somewhere. I would be very aprehensive about using a credit card if the prices of any or all of my purchases could be adjusted upward later on!

It seems to me that the credit card company and/or store should have spoken to you first about the 2nd unauthorised transaction and that both companies could be on shaky legal ground. I would be curious to know what explanation the credit card company has for approving the 2nd transaction that you had not approved or were even aware of until after it had been made.

I would phone the credit card company and ask for an explanation as to why a new transaction was approved without your approval or knowledge. Ask if this is policy and what is there to protect you from this happening to any other past or future purchases?
