I lost my job. I fell behind on a credit card. They constantly call my home (I don't live at home). They accepted a $155.00 payment from my mom over the phone & told her that that would catch me up & that I would just get a regular monthly bill now. Well, a few days later they started in on my mom again so now she doesn't answer her phone. This is difficult on her as she is a disabled veteran & getting up & down is hard on her. This credit card company (Chase Mastercard) also contacted a friend of mine & asked if they knew of other ways to get a hold of me & now they call my friends cell phones constantly during the day & evening. I have tried talking to them & they say they want the entire amount & will not accept anything else. Is it alright to send them what I can & how do I get them to stop calling my friends & telling them things like hinting in their own words that I am a deadbeat. Help! |

Kat H (our collection agent friend) was so busy preaching she obviously didn't read the part where you said you tried talking to the credit card company, but they refused payment arrangements.
At this point, there is little you can do. The Fair Debt Collections Act does not apply to the original creditor (Chase) so they can pretty much do whatever they want as long as they don't cross the line of "harassment".
The reason they are pestering your friends/relatives is because they are searching for you. So let them find you! Call them up, have your "Studly's Guide to Obscene Collection Agents Language" at your fingertips, and get into their face. After a few calls they won't even want to talk to you again.

I am not too sure if they are allowed to call friends without your consent. If you used them as a reference, then maybe they could ask them for a contact, but they do not have the right to constantly bug friends and family. I hope that all of this gets better. |

Send them a cease and desist letter immediately. By law, they can not call you again once you demand they stop.

Write a letter to the credit card company stating to cease and decist any calls to anyone on this matter. State that the only contact allowed will be through written correspondence. Send it Certified Mail Return Receipt Requested. If the calls do not cease (and let everyone know if they answer the phone to document who they spoke to, the date of the call and what the conversation consisted of). Then go to this website I included in the "source" section and file a complaint with the Federal Trade Commission. There in the subject section you would select "Debt Collection" and fill out all of the pertinent information.
I hope this helps you stop the harrasment. However, it would be in your best interest to make good on the debt.
PS: I have also provided a link on the Fair Debt Collection Act. Print it out and read it and keep it as reference. |

Tell them you will have your attorney contact them. They do some pretty low things all within the limits of the law but harassment isn't one of them. Let them know that you would like to talk to a manager now and if they refuse tell them you will also contact the FCC. Believe it or not that usually works because when the FCC gets involved it becomes a federal case. Also if you check out this website you may be able to have them write a letter to get them to stop. When the letterhead comes from an attorneys office they tend to listen.

Before you judge the credit card company, ask yourself, did you keep in contact with them when your bill got behind? Did you give them a phone number where they can reach you?
The credit card company sounds like they are close to charging off your account. It is very bad to have that on your credit. If you don't make your payments, and don't make arrangements for reduced payments, they are going to try and get their money.
I worked in collections for 3 years. The biggest problem people had was the phone calls. They would never answer the calls, because they knew we were collecting. We had to pull out their references and start calling moms and friends. If you just talk to them and keep in touch, they won't call anybody else. If you don't have a phone, you may have to call them and make payment arrangements.
If you don't pay and you don't communicate, they will charge off your account. That's even worse. |

Credit card companies that are alling your friends and mom are hoping that they will get sick of getting their calls and give them a direct line to you! The ones calling are the collectors and they can be ruthless! Ask for a supervisor. As far as wanting the whole thing, it depends how far behind on pymts you are, most of the time they are willing to work with you.
Your friends can try telling them not to call them again, but usually once they find someone who knows you, they hound the **** outta them, hoping that your friends will get mad and you will take action to contact them. |

Studly is right here as well. This account is considered First Party collections, ie- Chase collecting for Chase. None of the things the other people said are going to be effective. The FTC and the FDCPA are aimed at 3rd party collections, IE ABC CO collecting for Chase.
I would contact Chase and set arrangments with them. Ask them to stop calling you contacts and call you instead. I do not agree with the bogus Number advice Studly gave you. I do agree with alot of his theories, but I am a firm believer in paying your debt and not running from it and hiding fomr your responsibilities like Studly advises.
Yes, some collectors are rough, but they have to deal with the scum of the earth all day long, that would taint me as well. |

Next time they call your mother have her tell them she will not accept anymore calls from them and they must stop calling her or she will persue legal action through the fair credit act. You need to call the company and tell them you are legally requesting that they no longer call you and/or any of your friends or relatives or you will report them. Make sure to send a follow up note asking that all communication be made through the mail and you do not want them calling you and or any of your friends or relatives and all communication with you must be in writing.
You may want to consider using Consumer Credit Counseling or some other group to help you settle this debt they are used to dealing with these companies and can assist you in slowly repaying the debt without harrassment and interest charges. |
