The only way that a creditor can force the sale of your house is through a foreclosure preceding. This is a court mandate that allows a lien to be placed on the property by a creditor. If they only place the lien you can pass that onto the new buyer to deal with, but you must be up front in explaining this to them. Otherwise you will be in default at sale time for not disclosing this prior to the closing of the property. Most creditors will take into consideration that you are trying to sell the property and will work with you to get their money. The last thing they want is a house to sell, they are bankers not realtors. Keep in mind though that if they do sell your house at a foreclosure auction, you are still obligated to pay the difference between the selliing price and the amount you still owe on the property at the time of the actual foreclosure including taxes. Hope this helps.

Dont let them threaten you, You have to go through forclosure before anyone takes your house. Talk directly with your lender and dont take up any 'we will save you' loans they are crooks.

Unfortunaly yes they can, depending on the circumstances. I'm not familiar with Canadian law, however. Here in Texas, if you have equity in your home (I believe it's 15 or 20%), and have creditors who take you to court for payment, or you attempt to claim bankruptcy, the court may require you to sell your house, and use the profits from the sale (the equity) to pay your creditors before dismissing any remaining debt.

I know nothing...but, only if the creditor who's chasing you is the mortgage lender can they take your house. If it's a credit card company, I don't believe they have a right to take your home. Have you been to a credit counselling agency? They should be able to tell you what the laws are.

Not just any creditor. However, the creditor than holds a mortgage on the house can start a foreclosure action if you don't pay the mortgage. Some U.S. states do not allow creditors to take your home in a bankrupcy unless it is collateral for a loan. I'm not familiar with Canadian law, but assume it is based on English Common Law. If you have very little equity in the home, it is unlikely that anyone would force a sale since the expenses involved would be more than the equity. The mortgage would have to be paid off first before any other debts could be satisfied. However, some might threaten to do so as a harrassment technique.

No one can force u to sell your house. No one can force u to buy a house. If u want to sell your house do so by leaving out all the lawyers and real eststate agents There for u won`t have all the extra expessn in volved. There for u are not pushed or presured in to selling your house. Just sell your house privately and u save cashhhhhhhhhh.
