m yhusband and i are about to be garnished for a medical bill. I am not trying to snake out of paying it but we missed a payment to the collector when we were in hospital having our baby. when i talked to the collector he said since i missed the payment he was going to go legal on me. my husband and i are hard workers we live within our means. we dont have credit cards or loans the only bad credit we have is medical bills. since i just had my baby my husband is the only one working and he brings home 1600 a month and our monthly bills are 1300 not including gas or food. I just cant afford to be garnished and I dont know what to do. I would love some advice |

Most states allow the judge to order installment payments that are within your budget.
You will need to file a motion for installment payments, and may have to supply evidence of your income/expenses. |

There are some financial service organizations (usually community non-profit) who may be able to help you manage your affairs and bail you out of this garnishment. But move fast..and get in touch with one immediately if you want to intercept this problem. |

Go to the courts and explain it, a normal civil court should understand this probelm. You might need a lawyer, but you can resolve this probelm without having to be garnished. |

yeah you can stop it , he cant do anything as long as your paying on the bill . For medical bills you can send the 1 dollar a month and they can legally garnish you. Don't sweat it , he's a collector, tell him to stop harassing you pr your getting a lawyer, Pay your bill from now on , and next time he calls tell him your NOT going to talk to him , you need to speak to someone like a manager.
btw if your husband ONLY gets 1600 a month sounds like you need to get a job too |

You can show up to the hearing, complete a personal financial statement and enter into a payment arrangement. They MAY insist that whatever you agree to be automatically withdrawn from your paycheck, but if you let the garnishment go forward without trying to negotiate, they may take more than you feel you can afford. |

I DON'T KNOW IF YOU CAN STOP IT OR NOT BUT I DO KNOW THAT ONLY ONE PERSON/BIS. CAN GARNISH YOU AT ONE SINGLE TIME. I THANK THEY BASE WHAT THEY DEDUCT FROM CHECK ON HOW MUCH YOUR INCOME IS, AND WHAT YOUR BILLS ARE. BE SURE TO GO TO YOUR COURT DATE AND EXPLAIN YOUR SITUATION TO THE JUDGE OR HE WILL PROBABLY GIVE THE SUING PARTY THE MAX AMOUNT PER WEEK. GOOD LUCK! |
