You can sue anyone or any corporation. Winning is a different idea.

Why not try working with them to have them rectify their error? They might well respond positively to this.

you'd have to prove that you were harmed by this error and find an attorney to take your case.

my guess is the attorney would cost too much for this to be worth chasing.

I would sue the credit bureau for placing it on your report when it is not yours. The credit bureaus then have the responsibility to validate that debt, and if they can't or fail to, then they must remove it from your report. If they don't, you need to sue them. File complaints with all three reporting agencies: TransUnion, Equifax, and Experian

If no one knows who made the error, who would you sue? You can only sue someone if they did it maliciously and/or it caused you damages that you can prove in court.

If it caused you loss that you can document, you might recover your loss. You still need to write the credit bureau disputing the item. They should remove it if it cannot be verified.

Yes, you could, but first you have to follow a very specific process that includes disputing the item with the credit bureaus and creditor. Under the FCRA these people must be allowed to correct an error before they can be held liable.

If you went through the process and they still didn't remove the listing, then yes, you could easily sue and win.

actually you can sue anyone for anything... Now would you win, thats another story, I dont think it would be worth your wild to sue....
However there is a solution here. dispute this with the credit bureau's (all 3 of them), it is free to dispute with them... once the dispute process is started then legally the credit bureau is on a time limit and gives the creditor who placed it on your credit a couple weeks to respond.... now you say they have not proof of the debt... so then it will be taken off immediately once no proof has been given to the credit bureau's

What damages would you be suing for? What's the reason? You should consult with a licensed attorney.

That is ridiculous but shouldn't you have dealt with this long ago or did you discover this recently? That's pretty appalling. Maybe it's a problem with the credit bureaus?

Have you tried speaking with a manager? If it's a big company then try finding out who the head guy is (CEO, President, VP Operations). Call them or send a letter. Obviously this is a problem that needs to be addressed. But a first line employee won't be able to handle it. Go higher and keep going.
