rmuniz007 | Can i sue my credit card company? |
I try to make is short. Last year, I made my final payment on my interest free consumer credit card via online banking. When I got my following statement it shows that payment was not received and I incurred the interest that incurred while I was in grace period. I found out that the my consumer credit card change account number and that is why my online banking payment was rejected. I check with my online banking and for about 5 months my consumer credit card company was still receiving payment using my old account number...it just happened to be the last payment that was received and then rejected. I send them a letter along with my online banking statements showing why have they received payment for 5 months and not accept my last payment. To no avail, they did not want to work with me. Now, I have incurred $2000.00 and I don't want to pay it. I did pay send them my final payment along with my letter, but that is all they are getting. What should I do next? |

Small claims court, they probably won't show up and you will win. |

Ask for a copy of the letter they sent you when they changed your account number. If they can get you that, you'll need a lawyer to fight it and it's not worth the money or effort. You'd do better to try and keep it off your credit report by making them prove to the credit agencies that you are in default. They may not bother so the debt won't hurt you.
But realistically; your screwed. If an offer is too good to be true, it is. |

You could contact your local TV news station to see if they have consumer reporters who would contact the credit card company on your behalf. Recently I contacted KGO San Francisco Channel 7 news near where I live and they contacted AT&T and I got over $350 in "accidental" phone charges removed from my bill. Also you have to keep calling, writing, emailing, and asking to speak to supervisors until you're blue in the face. Someone will either just do it because they're sick of hearing from you or maybe your well-reasoned and documented arguments finally get someone's attention. Exceptions are made all the time because fighting people just isn't in the job description of most people and the companies don't really mind losing a few bucks here and there. |

You need to find out what the reason was that they changed your account number in the first place (was it just cause they felt like it??) and also what notification they sent you when they changed it. If they can't give you that information I would contact a lawyer or write the company a letter (see the link below). If they didn't have have a good reason for changing your card # or if they didn't let you know then they are liable! Good Luck! |

I don't think there is much that you can do. Contact a lawyer. |

You can sue them.......but for what? Remember that you are the one who owes them, so what are you going to sue them for? Tey haven't done anything yet.
Follow the advice of the previous letter. Send a certified letter requesting an explanation of why the account number was changed, and who requested that it be done.
Keep and save all documentation that shows you attempted to make the online payment, and any documentation showing it was received/rejected.
This is all you will need to support your claim when they attempt to sue you in court.
If they attempt to post anything to your credit report, then follow the dispute/validation procedure. If they don't remove the listing, then you finally have grounds to sue them for posting inaccurate information to your credit history.
But for now, just gather your information, keep talking to the credit card company and negotiate this away. If it gets to a point where they are like talking to a rock, then tell them you are finished talking and they can sue you.
I think you can defend this easily. |
