And he will continue to trash your credit and there's nothing you can do about it. If he stops paying all together, you can at least take steps to repo the car. But as long as he just pays late, you are out of luck.
This is going to be a very costly lesson. NEVER, NEVER, NEVER co-sign for anyone you are not legally married to. |

There was a reason your boyfriend needed you to co-sign the note: The finance company knew he couldn't handle the car payment based on their review of his credit history.
Your boyfriend asked you to assume a credit risk that PROFESSIONALS wouldn't even assume. And quite frankly, I don't think you knew your boyfriend well enough to assume such a risk.
Never co-sign a loan for anybody UNLESS you are very comfortable with the possibility of paying the loan in full, should the primary debtor fail to make the required payments.
It's not a surprise that this car note lasted longer than your relationship.
That is why you should have told him "Oh hell's no!" from the very beginning and bought him a bus/rail pass. |

Nope. You're stuck making payments on a car you can't find for an ex-boyfriend you don't want to find.
By cosigning the loan, you promised the bank:
"If my boyfriend doesn't pay, then I will."
The bank has every right to hold you to your promise.
Remember: "Bad Credit Score" = "I promised to repay a loan, then didn't".

(No, theres not way to get your name off with out him re financing the car .
My brother went through a similar process, when his ex girl friend dose not make the payment they take the money out of his checking account. He took her to court after she was over 12 payments behind on the car and the judge did not grant him the car.
So I would suggest couples therapy |

It is a just and legal debt for both of you. If you co signed then you are just as responsible as he is for payment.
The key here is who was the title put in the name of when paid in full, both of you, or just him, and who is the car registered to. If the car is paid off and it was a joint loan, you would own half the car. If you just co signed, wow what a terrible thing to do to someone. Are you sure, the loan is not in both your names? That is to say the car was sold to joe and Joanne. Or sold to joe, and co-signed by Joanne
Even if he does not pay, as co signer you have to pay for the car, but if he has the means to pay, and is not doing so, on purpose, this could be construed as fraud. If he is ill, or unemployed you haven't much to stand on,,,,,,,,now. You have to pay, but you can sue him, and if you can show that this was done intentionally, may be able to raise the level of interest of the authorities.
One other way, to get him back. It will hurt your credit now, but can be fixed later. Stop making the co-signer payments, the car will be repossessed. Bingo, no free car for ex-boyfriend, and then make a settlement on deficiency balance if there is one, the difference of what they got for the car, and the balance due on the loan note, the settlement in your name only.
Never co-sign unless you know for sure.......and that also goes for giving a second mortgage to a friend, or relative. |
