Can my credit card provider recover dues from my saving account when both are from same bank but no link in 2?

What credit card companies do very subtly is that in the Terms and Conditions they have a clause which says "I have obtained and read the contract...." This is in very fine print which nobody reads. Most card companies have this. In the terms and conditions, this debit authorisation is usually present. Since its the same bank, In all probability you have signed an authorisation while taking the card, so I guess they will do it.

YOu need to obtain the contract copy from this bank (they are obliged to give it to you), and check if this clause exists. If it doesnt, they CANNOT touch your savings accounts. You can sue them if they do

Kathryn K
Legally, they can. But, they probably won't. It is more profitable for them to let you be late or over limit and collect the fees than to force a payment from your account. So, unless you are EXTREMELY late or WAY overlimit, they will let you do it and incur the fees. If it comes down to it, they are also more likely to close your credit account than to force pay. However, if they have told you that they are going to do that, yes, they can.

jason
read your fine print but yes they can.

i would change my saving to another bank if you are that concerned.

yes they can
only if you have authorised them to do so.
OR
when signing for your credit card application there was a clause in there.

otherwise never allowed

The answer is "it depends." It may be automatically allowed by state law. It may be prohibited by state law unless you consented when you opened the account(s). You might have agreed to it when you opened your savings account, or you might have agreed to it when you opened your credit card account. You have to read the Terms and Conditions of each. Look for words like "right of offset".

This is one reason why it might be a good idea not to keep money in the same bank where you have a credit card or loan.

YES they can if u had a credit card on that account then they can debit the minimum balance of ur bill from ur credit card & u hve to call ur bank & check with them due u hve any standing instruction on ur account because wen u tke a credit card its mention in the terms & condition that u are giving them authorite to debit a particular amount on a particular date from ur account & its not nec. that ur both acc. & credit card should be linked becze in term & condition u hve signed that they can debit the minimum amount on the due date frm ur acc. So check with ur bank acc. for any standing instruction.
