martin g | Can provident loans take me to court? |

The Answer
 |
I wouldn't worry about it, I know a lot of people who have got involved with this particular company and many like it and they have defaulted on the repayments. End result of it has been nothing. They keep sending you the letters, frequently at first then it's just every now and again and eventually it'll be twice a year ( if that ). It's not actually financially viable for any company to take you to court for such a small amount and most just write it off.
Chances are anyway that any decent law system would laugh them out of court due to the ridiculous amount of interest they add to their loans.
And for all that'll say " well you knew what you were getting into " try putting yourself in this persons and many more like hers position and see what it's like. So to answer the question, DON'T worry about it. Better still, if you can afford to, contact them and offer them a token amount on a weekly/monthly basis, if they don't agree then send them to me, Haha !! |

yes and yes
if you are struggling go to CAB, they will try to get them to accept an affordable monthly payment. |

yes. make an arrangment with them or seek advice.
the longer you leave this the worse it will get sadly |

Of course - you owe them THEIR money. |

Of course they can, you loaned money off them and it is their right to claim it back. |

As someone who does this for a living the short answer is yes! You took a loan and you haven't paid it back. If you cant afford it you need to discuss this with them and come to a payment arrangement. If not they can take you to court and all court costs will be added to the debt.
I would advise you contact Payplan/CAB/Consumer Credit Counselling Services who will all be able to provide you with free and impartial advice. DO NOT pay a company to do this for you. They will liaise with Provident for you and agree a repayment plan based on your income/outgoings. |

Yes they can. the law is on there side.
You should contact them to arrange a minimum amount to pay, offer them what you can realistically afford to pay.
They will more than likely accept, all they want is there money back by whatever means they can.
It will also stop a CCJ being put against you. |

i disagree with the answer that the answer gave they are a legal loan company and if you don't come to an arrangement they can take you too court and apply for the money from your benefits or work money you get as you gave them you national insurance number so they can do it if you offer them what you can afford they can't refuse |

Yes they can, and what's worse is that they can claim the interest for the last 2 years if they wanted to. You could also be charged court costs which would be added onto the sum owed. Either contact them and arrange an agreed repayment method, or call a debt management company (they charge a fee though so watch out).
Ignoring it is definitely not the answer. |

Yes, you haven't paid what you owe |

Yes, they are a LEGAL loan shark...I find their levels of interest disgraceful but it's all within the realms of the law. |
