They can if the teller didn't bother to look at the date...other wise most banks wont cash them directly...but if it's for a bill of some sort..alot of places are using electronic withdrawls instead of sending it in and waiting for it to clear...take Wal-Mart for example...the treat the checks as an atm withdrawl and it's immediately withdrawn from accounts when you hand it over to the cashier. |

Yes the person can still send the check through because no one sits an personally checks the dates.
Collection agencies often do this, hey check your balance and put the check through if there are funds to cover it. In fact they will even use an automated check to with draw from the account rather than send the check through. |

Post dated checks are one of those things that may or may not be caught at the teller line. Most banks or credit unions will not deposit a post dated check if they catch the date. Unfortunately, the truth is, if you are writing a post dated check, the circumstances are probably not the best anyway and the diligence of the front line at the bank are probably not trained for posted dated catches. The company/person getting this check from you, probably has a long deposit of these checks and getting this person through the line with speed so as to get to the next person will cause most of these checks to slip by. You know if someone wants a posted dated check just say hey, I will be back that day to give you the check. Not what they are looking for but it will save you the thirty five bucks the bank is going to charge you. |

Yes. Technically, post-dated checks are illegal to write. The date field is the date you signed the check, NOT the date you want it to be cashed.
Also, banks dont look at the date anymore. Checks fly through their system at a million miles per hour, and the date field is pretty much disregarded. |

Yes, they can. If you read the agreement you got when you opened your checking account, it very likely says the bank is not responsible UNLESS you notified the bank in writing ahead of time.
It's best to avoid writing post-dated checks if you can, but if you must, notify your bank to protect yourself. I don't know why people are saying it is illegal to write post-dated checks, when my bank's account agreement clearly states it can be done but they may still cash them early unless I notify them in advance of the check being presented to them for payment.
If it was illegal, they would not have a method for handling such checks. |

It is not illegal to write a post-dated check, AND it is not illegal to cash a post-dated check. The only illegal part is requesting that someone write a post-dated check. You can legally request that someone give you a check to hold until payday, and they can even write that date on the check if they like.
Collection agencies love post-dated checks because they now have a commitment from you. By the way, it matters not if you have sufficient funds to cash the check. Your bank will likely honor the check and charge you a Non Sufficient Funds (NSF) fee.
If you are having trouble with collection agencies, post-dated checks are normally a bad idea. |

Banks don't check the dates anymore. They send them through. That's why you never give post dated checks to anyone. |
